ADVOCATE -for the City of Miami to receive additional Stimulus monies from the State of
Florida.
HOME RULE
SUPPORT - the preservation of local home rule; and OPPOSE any effort to preempt local
authority.
CRIMINAL JUSTICE/LAW ENFORCEMENT
SUPPORT Red light cameras: Authorizing the use of traffic cameras to enforce moving
violations under Chapter 316 of the Florida Statutes and allow the issuance of traffic infractions.
AMEND - 893.138 entitled "Local administrative action to abate drug-related, prostitution -
related, or stolen -property -related public nuisances and criminal street gang activity." to
include acts of violence including murder, rape, assault and battery. This would allow the City
to use the Nuisance Abatement Board to close establishments (like nightclubs) where there
have been more than two incidents of violence.
AMEND - Section 893.13 to enhance the penalty for the sale of narcotics within 1,000 feet of a
homeless shelter. Presently the State Statue for the Sale of a Controlled Substance and
Possession with Intent to sell has an enhanced penalty If the violation of the law is wlthin 1000
feet of a school or church. We should be able to include the homeless as part of a vulnerable
population that needsthis extra protection from criminals that prey on them.
AMEND Chapter 316 to make it unlawful for an operator of a motor vehicle to use a
commercial mobile radio services and electronic communications devices while driving. (Ban
use of cell phones and/or texting while driving)
ECONOMIC RECOVERY
Sadowski Cap Repeal — SUPPORT legislation preserving the dedicated documentary stamp fees
as a funding source for the State and Local Government Housing Trust Fund (Sadowski Trust
Fund). it eliminates the cap placed on fund distribution, and prohibits any of these trust fund
dollars from being diverted to the General Revenue Fund.
RENEW - SHIP fundingto $2.2M --Staffing is reduced throughout the State without SHIP
program causing additional unemployment
MODIFY - Florida Statutes Chapter 193 —SUPPORT legislation directing property appraisers to
use an income based approach when calculating the value of low to moderate income rental
properties for the purpose of property tax assessments. The modification requested will direct
property appraisers to either solely use or place greater weight on the income derived from low
to moderate Income rental residential units when determining their value for taxable purposes,
In this way, the value is set by actual gains from the property and not speculative market
derivations.
JOB CREATION
SUPPORT - legislation creating a state tax credit for small businesses (25 employees or fewer)
that invest in specialized training for employees, Tax credits would be given to cover the cost of
retraining existing and new employees in the fields of sustainability and technology,
SUPPORT— Film industry Caucus
ADMINISTRATIVE
AMEND — create an exemption for "administrative investigations" that would allow the City to
exempt files and documents of pending investigations until said investigations are closed. F.S.
Ch, 119 already allows for the exemption of records compiled in preparation of collective
bargaining negotiations, and most similar to what we are proposing, there is an exemption for
material relating to investigations of complaints against employees of the public school system,
There is also an exemption for investigations of discrimination complaints until the
investigation is closed.
GREEN/ENERGY POLICY
Sales Tax Refund for High Efficiency and Alternative -Fuel Vehicles - SUPPORT the creation of a
substantial sales tax refund for energy efficient vehicles that includes vehicles with high fuel
economy ratings, hybrid vehicles, alternative fuel vehicles, fuel cell vehicles, and advanced lean
burning technology vehicles. Support the state issue financial incentives and grants to'support
municipal fleet conversion to high efficiency and/or alternative -fuel vehicles.
SUPPORT Florida Forever funding for Parks
AMEND — Statute 193.501 to provide a tax deferral for an owner who agrees to covenant the
use of land for "outdoor recreational or park purposes for a period of not less than 10 years."
Seek legislation for 5 years.
FUNDING REQUEST
City of Miami Stormwater Master Plan Implementation $650,000
The City of Miami's Office of Capital Improvements requests funding for the City of Miami
Storm water Master Plan Implementatlon. This project has the potential to improve water
quality, to mitigate or reduce the risk of flooding caused by storm events and to conveythe
direct or indirect discharge of storm water into the Miami River (or their tributaries) and
Biscayne gay. These are environmentally friendly projects aimed at creating "green -collar jobs";
reducing fiooding and enhancing water quality prior to discharge into Biscayne Bay. it is
Important to note that Biscayne Bay is a South Florida Water Management District (SFWMD)
priority water body.
Judicial Qualifications — SUPPORT legislation increasing the experience level of county and circuit court
judges from five years to ten years membership in The Florida Bar. Currently, county and circuit court
judges are required to be lawyers and members of The Florida Bar for five years.
Assisted Living Facilities- SUPPORT legislation requiring Assisted Living Facilities that hold a mental
health license or serve residents with (severe) mental health illness to provide 24-hour security services
to its residents by security personnel licensed by the State of Florida.
