SUBJECT : Request for Acceptance of Donation

It is respectfully requested that you allow the Miami Police Department to accept a donation
by the U.S. Marshals Service for the purchase of two (2) new vehicles for members of the
Miami Police Department participating in the Regional Fugitive Task Force. The U.S.
Marshals Service will make direct payment to commercial vehicle dealerships for vehicles
purchased for our local investigators who participate in this joint law enforcement task
force. At present, the Miami Police Department is utilizing rental vehicles obtained via
LETF monies made available through City Commission approved protracted/complex
investigation funding. The value of this donation/amount appropriated by the U.S. Marshals
Service for the purchase of two (2) new vehicles is $50,000.
Background:
The City of Miami entered into a Memorandum of Understanding (MOU) with the U.S.
Marshals Service in August of 2009 for the overtime reimbursement of Miami Police
Department's sworn members participating on this task force. (See copy attached). As
required by this MOU, each participating agency agreed to furnish one vehicle for use by
the task force for each law enforcement officer assigned to the task force. In addition, each
agency was responsible for fuel, maintenance, and other expenses associated with the use
of its vehicles. The Miami Police Department met the vehicle requirements of the MOU by
utilizing LETF monies allocated for protracted/complex investigations by the City
Commission.
Recently, the U.S. Marshals Service offered the Miami Police Department up to $50,000 to
acquire two (2) new vehicles for use by our officers assigned to its Regional Fugitive Task
Force. This offer is contingent on the City of Miami agreeing to accept this offer by
signing the attached "Fiscal Year 2009 - Memorandum of Understanding — Regional
Fulgitive Task Force" between the Miami Police Department and the U. S. Marshals
Service for the period from August 17, 2009 to September 30, 2009, with an appropriation
of $50,000.00, by September 30, 2009.

Should you agree to accept this donation, the monies currently utilized for the rental and
operation of the vehicles used by the Miami Police Department officers assigned to the task
force will be utilized solely for the maintenance and operation of the new vehicles donated
by the U.S. Marshals Service. This will result in a cost savings to the protracted/complex
investigations allocation since we will no longer need to rent vehicles for the two (2) officers
assigned to the task force. No city general funds will be required for the purchase,
maintenance and operation of these new vehicles to be used by our members
participating in the Regional Fugitive Task Force.
Action Required:
Although the amount of the donation by the U -S. Marshals Service exceeds that allowed
under Section 18-115 of the Miami City Code for acceptance by the city manager, it is
requested that you sign the attached MOU and that we bring this matter before the City
Commission at a later date for ratification. Otherwise, the City of Miami/Miami Police
Department will not be able accept this donation within the timeframe established by the
U.S. Marshals Service.
If you concur, please sign the attached original memorandum of understanding that has
been provided to the Miami Police Department by the U.S. Marshals Service.
