AN ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED "THE 7191CHBORHOOD INITIATIVE GRANT FOR MODEL CITY COMMUNITY REVITALIZATION DISTRICT TRUST" FOR CERTAIN SPECIAL PROJECTS AND APPROPRIATING FUNDS, IN THE AMOUNT OF $1.25 MILLION, FROM THE UNITED STATES DEPA.]RTMENT OF HOUSING AND URBAN DEVELOPMENT IN SUPPORT OF THE MODEL CITY HOMEOWN8RS141P PILOT PROaECT1 AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANT AND TO EXECUTE ANY DOCUMENTS NECESSARY, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, POR ACCEPTANCE OF THE GRANT; AND CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE, WHEREAS, the United States Department of Housing and Urban Development has advised the Model City Community Revitalization District Trust ("Trust") that it has been awarded a special grant in support of the Model City Homeownership Project from the Fiecal Year 2003 Appropriations Act, the Neighborhood Initiative Grant for certain earmarked projects, in the amount of $1.26 million; and 12 37 4 TUN -08-2005 12:29 CITY OF MIAMI P.03 WHEREAS, Section 12,5-29 of the Code of the City of Minimi., Florida, as amended, provides authority for the Trust to "solicit and accept grants, contributions and financial and non-financial support from individuals, private business interests, the general public, governmental entities, corporations and organizations, foundations and other philanthropic entities;" and WHEREAS, the Board of Directors of the Trust accepted the funds; and WHEREAS, the Board of Direccdrs has requested that the City Commission appropriate said funds for the purpose of land acquisition in the Model City Homeownership Zone Pilot Project area; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: section 1. The recitals and findings contained in the Preamble: to this Ordinance are adopted by reference and incorporated as if fully set forth in the Section. Section 2, A new Special Revenue Fund entitled "Neighborhood Xnitiative Grant for the Model City Community Page 2 of 4 1.2374 TUFI-08-2005 12:29 CITY OF N I AM I P.04 Revitalization District `Frust," for certain special projects to established, and resources are appropriated as described herein: FUND TITLE: Neighborhood InitiaCiv'e Grant for the Model City Community Revitalization District Trust RRSOURCES: U.S. Department of Mousing and Urban Development $1.26 Million APPROPRIATIONS: $1,26 Million Section 3. The appropriations are contingent upon funding by the United States Department of Housing and Urban Development and the Model City Trust's acceptance thereof. Section 4. The City Manager is authorizedV to execute any documents necessary, in a farm acceptable to the City Attorney, for acceptance of the grant. Section 5. All ordinances or parte of ordinance insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed, Section 6. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not-1�' affected. '-� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescxzbed by applicable City Charter and Code provisions.
