HomeMy WebLinkAboutR-09-0566Vop City of Miami Legislation < U R �O Resolution: R-09-0566 File Number: 09-01350 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 12/17/2009 A RESOLUTION OF THE MIAMI CITY COMMISSION, AFTER A PUBLIC HEARING, MAKING FINDINGS AND DIRECTING THE ELIMINATION OF THE CONDITION THAT ACCESS FOR EMERGENCY VEHICLES BE ALLOWED AT ALL TIMES THROUGH THE PERMANENT BARRICADES AT THE INTERSECTIONS OF SOUTHWEST 32ND AVENUE AND SOUTHWEST 18TH STREET, AND AT SOUTHWEST 16TH STREETAND CORAL GATE DRIVE, IN THE CORAL GATE NEIGHBORHOOD IN THE CITY OF MIAMI, FLORIDA, SUBJECT TO THE APPROVAL OF THE MIAMI-DADE COUNTY TRAFFIC DIRECTOR; DIRECTING THE PERMANENT PROHIBITION OF PEDESTRIAN ACCESS, IN ADDITION TO THE PERMANENT PROHIBITION OF VEHICULAR ACCESS, THROUGH AFORESAID BARRICADES; AUTHORIZING THE CITY MANAGER TO PLACE AND ERECT A WALL ACROSS THE ENTIRE WIDTH OF THE RIGHT-OF-WAY AT THE AFORESAID BARRICADED LOCATIONS; FURTHER DIRECTING THAT CONTROLLED ACCESS FOR EMERGENCY VEHICLES BE PROVIDED AT ALL TIMES THROUGH THE PERMANENT BARRICADE AT THE INTERSECTION OF SOUTHWEST 32ND AVENUE AND SOUTHWEST 19TH TERRACE, MIAMI, FLORIDA, SUBJECT TO THE CONDITION THAT THE TYPE OF CONTROL SHALL BE APPROVED BY THE CITY OF MIAMI DEPARTMENT OF FIRE -RESCUE; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE MIAMI-DADE COUNTY TRAFFIC DIRECTOR. WHEREAS, on March 9, 1995, the City Commission adopted Resolution No. 95-178, directing the permanent prohibition of vehicular access to certain streets in the Coral Gate neighborhood, Miami, Florida, subject to certain conditions; and WHEREAS, a condition of approval of said prohibition of vehicular access is that access, for emergency vehicles be provided at all times through the barricades located at the intersections of Southwest 32nd Avenue and Southwest 18th Street, and at Southwest 16th Street and Coral Gate Drive, Miami, Florida; and WHEREAS, the City of Miami ("City") Department of Fire -Rescue has opened the Shenandoah fire -rescue facility located at Southwest 22nd Avenue and Southwest 16th Street, Miami, Florida; and WHEREAS, the new fire -rescue facility provides improved emergency service to the Coral Gate neighborhood, thereby changing the conditions under which the permanent street barricades were originally approved; and WHEREAS, the City's Departments of Police, Fire -Rescue and Solid Waste have re-evaluated the effects of the permanent vehicular access restrictions upon their respective operations based on the changed condition, and have expressed no objection to the elimination of the condition that access for emergency vehicles and pedestrians be provided at all times through the barricades located at City of Miand Page I of 3 File Id. 09-01350 (Version: 1) Printed On: 7/12/2017 File Number: 09-01350 Enactment Number: R-09-0566 Southwest 32nd Avenue and Southwest 18th Street, and at Southwest 16th Street and Coral Gate Drive, Miami, Florida, provided that controlled emergency vehicle access be provided at the permanent barricade located at Southwest 32nd Avenue and Southwest 19th Terrace, Miami, Florida; and WHEREAS, pursuant to due public notice, a public hearing is being held before the City Commission on December 17, 2009 as to any objections to the elimination of the condition that access for emergency vehicles and pedestrians be provided at all times through the barricades located at Southwest 32nd Avenue and Southwest 18th Street and at Southwest 16th Street and Coral Gate Drive, Miami, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. After a public hearing, the Miami City Commission directs that the condition that access for emergency vehicles be allowed at all times through the permanent barricades at the intersections of Southwest 32nd Avenue and Southwest 18th Street and at Southwest 16th Street and Coral Gate Drive in the Coral Gate neighborhood in the City of Miami, Florida, be eliminated, subject to the approval of the Miami -Dade County Traffic Director. Section 3. The Miami City Commission directs that pedestrian access, in addition to vehicular access, through the permanent barricades at the intersections of Southwest 32nd Avenue and Southwest 18th Street and at Southwest 16th Street and Coral Gate Drive in the Coral Gate neighborhood in the City of Miami, Florida, be permanently prohibited. Section 4. The City Manager is authorized{1} to place and erect a wall across the entire width of the right-of-way at the permanent barricade locations at the intersections of Southwest 32nd Avenue and Southwest 18th Street and at Southwest 16th Street and Coral Gate Drive, in the Coral Gate neighborhood in the City of Miami, Florida. Section 5. The Miami City Commission further directs that controlled access for emergency vehicles be provided at all times through the permanent barricade at the intersection of Southwest 32nd Avenue and Southwest 19th Terrace, Miami, Florida, subject to the condition that the type of control shall be approved by the City's Department of Fire -Rescue. Section 6. The City Clerk is directed to transmit a copy of this Resolution to the Miami -Dade County Traffic Director. Section 7. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: City of Miami Page 2 of 3 File Id. 09-01350 (Version: 1) Printed On: 7/12/2017 File Number: 09-01350 EnactmentNnmber: R-09-0566 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date is was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
