4. The Property is being taken by the Grantee "as is" with the Grantee being solely
respor_sible for the removal of anti_' environmental contamination if present on the
Property, and
5. The title to the Property shall immediately and automatically revert to and vest in
the Grantor in the event that: (A) within six (6 ) months from the date of this
Corrective Quit Claim Deed, or such later date as nay be approved by the City-
CCrnmission of the City of Miami, the Grantee has not commenced construction,
to the satisfaction of the Grantor in its sole judgment, of a minimum of nine (9)
single-fan]ily homes, or a combination of nine (9) townhomes and condon]iniums
"hereinafter referred to as the "Homes"), on the Property; or (B) within six (6)
months from the date of this Corrective Quit Clain? Deed, or such later date as
n]ay be approved by the City Commission of the City of lvhanu; the Grantee has
not commenced construction, to the satisfaction of the Grantor in its sole
judgment, of a seven (7) unit multi- fan]ily rental project on the parcel located at
Lot 15, Block 12, of ORANGE HEIGHTS, according to the. Plat thereof, as
recorded in Plat Book 14, Page 62, of the Public Records of Dade County,
Florida, a.k.a. 1525 N.W. 60 Street, Miani, Florida, or (C) on or before April 30,
2008, or such later date as may be approved by the City ConrTnission of the City
of Mian]i: (i) the construction of all of the Homes has not been completed, as
evidenced by the issuance of Certificates of Occupancy, or (ii) all such single
family Homes have not been sold to qualified Low Income homebuyers (as
defined in the HOME Investment Partnerships Program Regulations, 24 CFR
Part 92), or (iii), the construction of the seven (7) unit multi- family rental project
has not been completed, as evidenced by the issuance of all required Certificates
of Occupancy, or (iv) the Grantee has not conveyed to the Grantor by Special
Warranty Deed the seven (7) unit multi- family rental project and the parcel
located at Lot 15, Block 12, of ORANGE HEIGHTS, according to the Plat
thereof, as recorded in Plat Book 14, Page 62, of the Public Records of Dade
County, Florida, a.k.a. 1525 N.W. 60 Street; Miami, Florida.
The sales price for each of the Homes shall not exceed $236,000.00 per unit.
