HomeMy WebLinkAboutPre Legislationa° r City of Miami Gi n C� Legislation Resolution: R-05-0357 File Number: 05-00536 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 5/26/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO: (A) CONVEY, WITH PARCEL REVERTER PROVISIONS, ELEVEN (11) CITY OF MIAMI ("CITY") OWNED PARCELS OF LAND DIRECTLY TO THE DEVELOPERS, AS DESCRIBED IN "ATTACHMENT A," ATTACHED AND INCORPORATED ("DEVELOPERS"), FOR THE CONSTRUCTION OF AFFORDABLE HOUSING FOR ELIGIBLE LOW AND MODERATE INCOME PERSONS, (B) CONVEY CERTAIN CITY -OWNED PARCELS OF LAND DIRECTLY TO THE CITY DEPARTMENT OF OFF-STREET PARKING ("DOSP"), AS DESCRIBED IN "ATTACHMENT B," ATTACHED AND INCORPORATED, FOR THE CONSTRUCTION OF PARKING LOTS, CURRENTLY SUBJECT TO ASSIGNMENT TO THE MODEL CITY COMMUNITY REVITALIZATION DISTRICT TRUST ("TRUST"), PURSUANT TO THE INTERLOCAL COOPERATION AGREEMENT BETWEEN THE TRUST AND THE CITY DATED SEPTEMBER 25, 2003, AND (C) AMENDING THE INTERLOCAL COOPERATION AGREEMENT TO PROVIDE FOR THE DELETION OF SUCH PARCELS FROM EXHIBIT "A" OF SAID AGREEMENT TO REFLECT: (1) THE CONVEYANCE OF ELEVEN (11) PARCELS DIRECTLY TO THE DEVELOPERS, FOR THE DEVELOPMENT OF AFFORDABLE HOUSING, (2) THE CONVEYANCE OF CERTAIN PARCELS DIRECTLY TO DOSP, FOR THE CONSTRUCTION OF PARKING LOTS, AND (3) THE CONVEYANCE OF FIVE (5) PARCELS TO PALMETTO HOMES OF MIAMI, INC., FOR THE CONSTRUCTION OF AFFORDABLE HOUSING, AS DESCRIBED IN "ATTACHMENT C," ATTACHED AND INCORPORATED, FOR THE CONSTRUCTION OF AFFORDABLE HOUSING, APPROVED BY THE CITY COMMISSION AT ITS APRIL 28, 2005, MEETING, SUBJECT TO THE TERMS AS STATED HEREIN; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 04-0374, adopted June 10, 2004, the City Commission adopted the City of Miami's ("City") Five Year Consolidated Plan re-establishing eight (8) Neighborhood Development Zones in the City; and WHEREAS, the City Commission identified the Model City Community Revitalization Zone ("Zone") as one of the areas to undergo comprehensive redevelopment; and WHEREAS, the City and the Model City Community Revitalization Trust ("Trust") entered into an interlocal cooperation agreement ("Agreement"), dated September 23, 2003, to set forth the cooperative relationship between the City and the Trust and the respective duties, obligations and procedures to be followed by the parties for planning and implementation of revitalization efforts for the redevelopment of the Zone and for the conveyance of certain City -owned parcels of land to the Trust; and City of Miami Page I of 3 Printed On: 10/30/2009 File Number: 05-00536 Enactment Number: R-05-0357 WHEREAS, in order to expedite the redevelopment of the Zone, the Trust by Resolution, at its May 16, 2005 meeting, authorized the City to convey certain parcels, currently subject to conveyance to the Trust pursuant to the Agreement directly to the Developers, as described in "Attachment A," attached hereto, for the construction of affordable housing and to the City Department of Off -Street Parking ("DOSP") and further amend the Agreement to provide for the deletion of such lots from Exhibit "A" of the Agreement and as otherwise required; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized(l) to: (a) convey, with parcel reverter provisions, eleven (11) parcels of City -owned land directly to the Developers, as described in "Attachment A," attached and incorporated, for the construction of affordable housing for eligible low and moderate income persons, (b) convey certain City -owned parcels of land directly to the DOSP, as described in "Attachment B," attached and incorporated, for the construction of parking lots, currently subject to assignment to the Trust pursuant to the Agreement between the Trust and the City dated September 25, 2003, and (c) amending the Agreement to reflect: (1) the conveyance of eleven (11) parcels directly to the Developers for the construction of affordable housing, (2) the conveyance of certain parcels to DOSP for the construction of parking lots, and (3) the conveyance of five (5) parcels to Palmetto Homes of Miami, Inc., as described in "Attachment C," attached and incorporated, for the construction of affordable housing approved by the City Commission at its April 28, 2005 meeting, subject to the following terms: (1) the terms of the conveyances to the Developers will be subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701 u (Section 3), (2) the Developers will work with the President/CEO of the Trust to identify qualified local members of the Zone, particularly residents of the 33142 zip code, to work on the construction of the homes on a priority basis, (3) the first priority homebuyers for the proposed homes will be individuals and families displaced from the City's Miami Limited Buildings, and (4) the sales price of the homes must comply with the affordable housing sales price approved by the City Commission. Section 3. The City Manager is further authorized{1 } to execute the necessary documents, for said purpose. Section 4.
