A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING A PAYMENT IN THE AMOUNT OF $1,385,556.20 IN
AFFORDABLE HOUSING TRUST FUNDS TO THE UNITED STATES
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ("HUD") 1N
ACCORDANCE WITH THE CITY OF MIAMI REPAYMENT AGREEMENT FOR
FUNDS OWED TO HUD, AS INDICATED IN EXHIBIT "A", ATTACHED AND
INCORPORATED; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL
NECESSARY DOCUMENTS FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No. 08-0641, adopted on November 13, 2008, the Miami
City Commission approved the acceptance of a grant from the United States Department of Housing
and Urban Development ("HUD") under the Housing and Economic Recovery Act of 2008 in the
amount of $12,063,702 for the implementation of the Neighborhood Stabilization Program ("NSP");

WHEREAS, on March 13, 2009, the NSP Grant Agreement between the City of Miami ("City")
and HUD was executed by the City Manager, as indicated in Exhibit "B", attached and incorporated;
and
WHEREAS, pursuant to Special Condition #1 of the NSP Grant Agreement, before the City can
access the NSP funds, the City is required to submit a repayment plan for the outstanding obligations
due to HUD because of certain compliance issues; and
WHEREAS, pursuant to Resolution No. 09-0278, adopted on June 11, 2009, the Miami City
Commission approved a repayment plan, as set forth in Exhibit "A", which provides for the City to
reimburse HUD in the amount of $1,385,556.20 for Fiscal Year 2010; and
WHEREAS, any payment made to HUD will be returned to the City's HUD line of credit and will
be used to further the goals of the Affordable Housing Trust Fund ("AHTF"); and
WHEREAS, the Administration recommends a payment to HUD in the amount of
$1,385,556.20 from the AHTF, in accordance with the City's repayment agreement for funds owed to
HUD, as indicated in Exhibit "A", attached and incorporated,
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. Repayment to HUD in the amount of $1,385,556.20 from the AHTF, in accordance with

the City's Repayment Agreement for funds owed to HUD, as indicated in Exhibit "A", attached and
incorporated, is authorized.
Section 3. The City Manager is authorized {1 } to execute all necessary documents for said
purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
