HomeMy WebLinkAboutExhibitAMENDMENT NO.2 TO CONSTRUCTION CONTRACT FLAGAMI/WEST END STORM SEWER IMPROVEMENTS PHASE IIB B-50695 This Amendment No. 2 to the Contract dated January 10, 2008 (the "Contract") between the City of Miami, a municipal corporation of the State of Florida ("CITY"), and Horizon Contractors Inc. ("CONTRACTOR") for the project entitled "Flagami/West End Storm Sewer Improvements, Phase IIB, B-50695," ("PROJECT") is entered into this day of , 2009. RECITALS WHEREAS, the Contract was entered into pursuant to the approval of the City Commission by Resolution No. 07-0701 in the amount of $5,589,096.50 for the Scope of Work, included in the original Contract Documents for the PROJECT, WHEREAS, a ten percent owner's contingency was also awarded, for a total award value of $6,448,006.15; and WHEREAS, Amendment No. 1, approved pursuant to R-09-0175, enacted April 2, 2009, increased the award value by $300,000 due to owner requested changes, regulatory changes, and unforeseen conditions; and, WHEREAS, this Amendment No. 2 is now necessary, approved pursuant to R- , amending the award value and the Scope of Work to provide for City requested driveway approaches within public right of way, differing quantities, tree plantings, differing site conditions encountered at West Flagler St. crossings, unforeseen utility conflict with an existing gas main on NW 63,dAve, and other unforeseen conditions and City requested changes, increasing the award value by $765,000; and, NOW THEREFORE, for the considerations hereinafter set forth: The Agreement dated January 10, 2008, is hereby amended as follows: Scope of Work is hereby revised to include all labor, materials and equipment required to perform the additional work, due to unforeseen conditions, utility conflicts, and City requested changes, such as City requested driveway approaches within public right of way, differing quantities, tree plantings, differing site conditions encountered at West Flagler St. crossings, unforeseen utility conflict with an existing gas main on NW 63rd Ave, and other unforeseen conditions and City requested changes . The Additional Work shall be performed in a manner consistent will all applicable terms and conditions of the Contract Documents. 2. AWARD VALUE is hereby increased by an amount not to exceed $765,000, thereby increasing the total award value to Seven Million Two Hundred and Thirteen Thousand Six Dollars and Fifteen Cents.
