HomeMy WebLinkAboutCertification And Declaration of Official Election Results 2009CERTIFICATION AND DECLARATION OF RESULTS ON THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 3, 2009 STATE OF FLORIDA ) COUNTY OF MIAMI DADE ) CITY OF MIAMI ) I, Priscilla A. Thompson, City Clerk of the City of Miami, Florida, and as the Canvassing Board for the City of Miami (hereinafter referred to as "Canvassing Board") do hereby certify that all necessary legal steps were taken in connection with the conduct of a City of Miami General Municipal Election held on November 3, 2009, including, though not limited to, the following Logic and Accuracy Tests: I. On Wednesday, October 21, 2009: A. Commencing at approximately 10:00 a.m. the Miami -Dade County Supervisor of Elections representative had the tabulating equipment tested to ascertain that the equipment will correctly count the precinct and absentee ballots cast for the candidates and/or issues, to be voted in the Miami General Municipal Election to be held on November 3, 2009. B. The Canvassing Board compared the test results with the predetermined totals for each candidate and pursuant to the requirements established in Section 101.5612, Florida Statutes, observed the performance and results of all required tests and verified the correctness of the programs and equipment, as well as any replacement of said materials required by said tests, subject to said tests. C. At the completion of the above test, there were delivered to us, in a sealed container with Seal Number 051929 the verified Logic and Accuracy reports and test materials, and steps have been taken to ensure the security of said materials prior to, during and subsequent to the election, except when said materials are properly in the possession of the Elections Department staff appointed to conduct the election. II. On Wednesday, October 28, 2009 throut1h Monday, November 2, 2009: A. On Wednesday, October 28, 2009, the Miami -Dade County Supervisor of Elections set the time to begin the opening of the valid absentee ballots and the duplication of ballots (as needed) at 10:00 a.m. and commencing at 1 p.m. 1 on Monday, November 2, 2009, the Canvassing Board resumed opening of the absentee ballots. 111. On Tuesday, November 3, 2009 (Election Day) A. At approximately 4:00 p.m., the Miami -Dade County Supervisor of Elections began the pre -count logic and accuracy test of the optical scan system used for paper ballots, located at the Elections Department at 2700 NW 87th Ave, to ascertain that the equipment had not been tampered with, and that it would correctly count the precinct and absentee ballot votes cast for all City of Miami candidates. B. At the completion of the precinct and absentee ballot count, the pre-election test of the automatic tabulating equipment was again tested at approximately 7:30 p.m., before the official count of ballots to ascertain that the equipment correctly counted the precinct and absentee votes cast for all City of Miami candidates. C. At the completion of the tabulation of election results, approximately 10:30 p.m., the Miami -Dade County Supervisor of Elections presented me with the certification of elections tabulation. Per Florida Statute 101.048(1) persons casting provisional ballots have the right to present written evidence supporting his or her eligibility to vote to the supervisor of elections by not later than 5 p.m. on the third day following the election. That deadline was Thursday, November 5, 2009. On Friday, November 6, 2009 we received the certified official tabulation of election results. IV. I further certify that all documents concerning the above Logic and Accuracy Tests showed the tabulating equipment to be functioning correctly and that said documents are presently in the possession of the Supervisor of Elections of Miami -Dade County, in containers which were sealed under seal number 015929and signed off by the Supervisor of Elections and the City Clerk. V. I further certify and declare that: • in the race for Mayor, Tomas Regalado received more than 50 percent plus one of all votes cast and is hereby declared to have been elected Mayor of the City of Miami; • in the race for Commission District 3, Frank Carollo received more than 50 percent plus one of all votes cast and is hereby declared to have been elected City of Miami District 3 Commissioner; • in the race for Commission District 4, no candidate received a majority of votes cast, and therefore a Runoff election will be required to determine who will be elected Commissioner of District 4. Francis X. Suarez and Manolo Reyes 4 having received the greatest number of votes cast in the General Municipal Election, shall be placed on the ballot at the Runoff Election scheduled for November 17, 2009; • in the race for Commission District 5, Michelle Spence -Jones received more than 50 percent plus one of all votes cast and is hereby declared to have been elected City of Miami District S Commissioner; • in the race for Coconut Grove Village Council members, Patrick Sessions, David B. Collins, Kate Callahan, Michelle Niemeyer, David Eric Wells, Renita Ross Samuels -Dixon, Heather Bettner, Stephen P. Murray and Felice Dubin were the nine (9) candidates that received the greatest number of votes cast and are hereby declared to have been elected Coconut Grove Village Council Members. VII. On Monday, November 9, 2009 (Post Election Audit) A At approximately 10 00 a in the Miami -Dade County Supervisor of Elections conducted a post election manual audit at the Elections Department at 2700 NW 87th Ave according to Florida Division of Election Rule IS -5 026 The audit entailed audit teams manually counting the ballots cast by absentee voting, early voting, and by Election Day voting, for a randomly selected precinct within a randomly selected race At the completion of the audit on Monday, November 9, 2009, at approximately 10 45 we received the voting system post election audit report WITNESS my hand and the official Seal of the City of Miami, Florida, this --6, day of November, 2009 Priscilla A Thompson, CMC, City Clerk Sworn to and subscribed before me this � day of November, 2009, by Priscilla A Thompson, who is personally known to me and did take an oath Nothry Public State of Florid+ Dwight S Dame My Commission DD617011 Expires 11/26/2010 R e, Notary Public
