A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR GRANT
FUNDING TO THE FLORIDA INLAND NAVIGATION DISTRICT WATERWAYS
ASSISTANCE PROGRAM, IN SUBSTANTIALLY THE ATTACHED FORM, IN AN
AMOUNT NOT TO EXCEED $80,000, FOR THE KENNEDY PARK SHORELINE
STABILIZATION -PHASE I PROJECT ("PROJECT"); AUTHORIZING THE
ALLOCATION OF THE CITY OF MIAMI'S REQUIRED MATCHING FUNDS FOR
FIFTY PERCENT (50%) OF THE PROJECT COSTS, IN AN AMOUNT NOT TO
EXCEED $40,000; ALLOCATING SAID MATCHING FUNDS FROM THE PARKS
SPECIAL REVENUE FUND B-30541; AUTHORIZING THE CITY MANAGER TO
EXECUTE ANY OTHER NECESSARY DOCUMENTS FOR THE SUBMISSION OF
SAID GRANT APPLICATION FOR FISCAL YEAR 2009-2010.
WHEREAS, the City of Miami ("City") wishes to restore the Kennedy Park shoreline and restore
tidal flow to the mangroves ("Project"); and
WHEREAS, the total cost of the Project is estimated not to exceed $80,000; and
WHEREAS, the City wishes to apply for grant funding from the Florida Inland Navigation District
("FIND") in an amount not to exceed $80,000, with the City's required matching funds of $40,000 for
fifty percent (50%) of the total Project cost; and
WHEREAS, the City is allocating the required matching funds of $40,000 or fifty percent (50%)
of the total cost from the Parks Special Revenue Fund B-30541;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1} to submit an application for grant funding to FIND
Waterways Assistance Program, in substantially the attached form, in an amount not to exceed
$80,000, for the Project, and to execute any other necessary documents for the submission of said
grant application for Fiscal Year 2009-2010.
Section 3. The City of Miami further certifies to FIND the following matters:
The City accepts the terms and conditions set forth in FIND Rule 6613-2 F.A.C., which outlines
the Waterways Assistance Program and which will be a part of the Project Agreement for any
assistance under this proposal;

The City is in agreement with the proposal and agrees to carry out the program in the manner
described in the proposal and any plan and specifications attached thereto; unless prior approval for
any change has been received from FIND;
The City has the ability and intention to finance its share of the cost of the Project and that the
Project will be operated and maintained at the expense of the City for public use;
The City will not discriminate against any person on the basis of race, color, or national origin in
the use of any property or facility acquired or developed pursuant to this proposal, and shall comply
with the terms and intent of Title VII of the Civil Rights Act of 1964, P.L. 88-352 (1964). The City will
design and construct the Project to comply fully with statutes relating to accessibility by disabled
persons, as well as other federal, state and local laws, rules and requirements;
The City agrees to maintain adequate financial records for the proposed Project to substantiate
claims for reimbursements; and
The City will make available to FIND, if requested, a post -audit of expenses incurred on the
Project prior to, or in conjunction with its request for the final (10%) of the funding agreed to by
FIND.
Section 4. The allocation of the City's required matching funds, in an amount not to exceed
$40,000, is authorized, with funds allocated from the Parks Special Revenue Fund B-30541.
Section 5. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor -(2)
Footnotes:
(1) The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
(2) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
