A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER APPROVING
THE FINDINGS OF THE EVALUATION COMMITTEE, PURSUANT TO REQUEST
FOR PROPOSAL ("RFP") NO. 149127,THAT LAW ENFORCEMENT
PSYCHOLOGICAL AND COUNSELING ASSOCIATES, INC., IS THE
HIGHEST -RANKED FIRM, IN THE BEST INTEREST, AND MOST
ADVANTAGEOUS TO THE CITY OF MIAMI TO PROVIDE PART A:
PRE-EMPLOYMENT PSYCHOLOGICAL SERVICES FOR SWORN PERSONNEL,
PART B: PSYCHOLOGICAL SERVICES FOR EMPLOYEES, AND PART C:
PRE-EMPLOYMENT AND POST -EMPLOYMENT SERVICES FOR CIVILIAN
EMPLOYEES, FOR THE DEPARTMENT OF POLICE; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE A PROFESSIONAL SERVICES
AGREEMENT ("PSA"), IN SUBSTANTIALLY THE ATTACHED FORM, FOR A
PERIOD OF THREE (3) YEARS, WITH THE OPTION TO RENEW FOR THREE (3)
ADDITIONAL ONE-YEAR PERIODS; ALLOCATING FUNDS FROM THE VARIOUS
_ SOURCES OF FUNDS OF THE USER DEPARTMENTS SUBJECT TO THE
AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF
NEED; SHOULD NEGOTIATIONS FAIL WITH LAW ENFORCEMENT
PSYCHOLOGICAL AND COUNSELING ASSOCIATES, INC., FOR PARTS A, B
AND C, THE CITY MANAGER IS AUTHORIZED TO NEGOTIATE AND EXECUTE
A PSA WITH THE SECOND-HIGHEST RANKED FIRM, HARLEY V. STOCK,
PH.D., P.A. D/B/A FORENSIC PSYCHIATRIC AND PSYCHOLOGICAL
ASSOCIATES, FOR PART A: PRE-EMPLOYMENT PSYCHOLOGICAL SERVICES
FOR SWORN PERSONNEL AND ISSUE A NEW RFP FOR PART B:
PSYCHOLOGICAL SERVICES FOR EMPLOYEES, AND PART C:
PRE-EMPLOYMENT AND POST -EMPLOYMENT SERVICES FOR CIVILIAN
EMPLOYEES FOR THE DEPARTMENT OF POLICE.
WHEREAS, the City of Miami ("City") issued Request for Proposal ("RFP") No. 149127 for the
provision of Psychological Screening Services, two (2) proposals were received, and deemed
responsive and responsible; and
WHEREAS, the Evaluation Committee, appointed by the City Manager determined that the
proposal submitted by Law Enforcement Psychological and Counseling Associates, Inc. is the
highest -ranked firm, in the best interest, and most advantageous to the City for the provision of
Psychological Screening Services, Part A: Pre-employment Psychological Services for Sworn
Personnel, Part B: Psychological Services for Employees, and Part C: Pre-employment and
Post -employment Services for Civilian Employees for the Department of Police; and
WHEREAS, the Evaluation Committee recommended to the City Manager to negotiate and
execute a Professional Services Agreement ("PSA") with Law Enforcement Psychological and
Counseling Associates, Inc. for Parts A, B, and C., and

WHEREAS, the Evaluation Committee recommended to the City Manager to negotiate and
execute a Professional Services Agreement ("PSA") with Law Enforcement Psychological and
Counseling Associates, Inc. for Parts A, B, and C., and

WHEREAS, if negotiations fail with Law Enforcement Psychological and Counseling
Associates, Inc. for Parts A, B and C, the City should enter into negotiations with the second-highest
ranked firm, Harley V. Stock, Ph.D. P.A. d/b/a Forensic Psychiatric and Psychological Associates of
Florida and issue a new RFP for Part B: Psychological Services for Employees, and Part C:
Pre -Employment and Post -Employment Services for Civilian Employees for the Department of Police;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The recommendation of the City Manager approving the findings of the Evaluation
Committee pursuant to RFP No. 149127, that Law Enforcement Psychological and Counseling
Associates, Inc., is the highest -ranked firm, in the best interest, and most advantageous to the City to
provide Psychological Screening Services, Part A: Pre-employment Psychological Services for Sworn
Personnel, Part B: Psychological Services for Employees, and Part C: Pre-employment and
Post -employment Services for Civilian Employees for the Department of Police, is accepted.
Section 3. The City Manager is authorized{1) to negotiate and execute a PSA, in substantially
the attached form, for a period of three (3) years, with the option to renew for three (3) additional
one-year periods, with funds allocated from the various sources of funds of the user departments,
subject to the availability of funds and budgetary approval at the time of need.
Section 4. Should negotiations fail with Law Enforcement Psychological and Counseling
Associates, Inc., for Parts A, B and C, the City Manager is authorized{1} to negotiate and execute a
PSA with the second-highest ranked firm, Harley V. Stock, Ph.D., P.A. d/b/a Forensic Psychiatric and
Psychological Associates, for Part A: Pre-employment Psychological Services for Sworn Personnel
and issue a new RFP for Part B: Psychological Services for Employees, and Part C: Pre-employment
and Post -employment Services for Civilian Employees for the Department of Police.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.{2}

M The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
