A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE PUBLIC WORKS DEPARTMENT TO ISSUE A TEMPORARY
ROAD CLOSURE PERMIT TO THE FLORIDA DEPARTMENT OF
TRANSPORTATION FOR PORTIONS OF THE RIGHT-OF-WAY OF NORTHEAST
37TH STREET, NORTHWEST 37TH STREET ALLEY,
NORTHWEST/NORTHEAST 38TH STREET AND NORTHWEST 39TH STREET,
WITHIN THE CITY OF MIAMI, FLORIDA, AS DESCRIBED ON THE LEGAL
DESCRIPTION, ATTACHED AND INCORPORATED, IDENTIFIED AS PARCELS
700, 702, 704, 705, 707 AND 708, FOR AN INITIAL PERIOD OF THREE (3)
YEARS, TO ACCOMMODATE THE RECONSTRUCTION OF PORTIONS OF THE
SR -112/1-195 (AIRPORT EXPRESSWAY);AUTHORIZING THE CITY MANAGER
TO GRANT EXTENSIONS TO THE INITIAL THREE (3) YEAR PERMIT PERIOD IN
INCREMENTS NOT TO EXCEED NINETY (90) DAYS IN DURATION; FURTHER
WAIVING THE FEES REQUIRED BY THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, TO OBTAIN SAID TEMPORARY CLOSURE PERMIT,
AND ANY EXTENSIONS THERETO,
WHEREAS, Northeast 37th Street, Northwest 37th Street Alley, Northwest/Northeast 38th Street
and Northwest 39th Street are dedicated public right-of-ways within the City of Miami, Florida; and
WHEREAS, the State of Florida Department of Transportation ("FDOT") is planning improvements
to the transportation facility SR -112/1-195 from 1-95 to Biscayne Bay; and
WHEREAS, a component of the FDOT plan includes providing shoulders and eliminating and/or
reducing weaving conflicts to and from 1-95, milling, resurfacing and drainage improvements; and
WHEREAS, the FDOT desires to temporarily close portions of the right-of-way of Northeast 37th
Street, Northwest 37th Street Alley, Northwest/Northeast 38th Street and Northwest 39th Street to
safely accommodate the reconstruction of portions of the SR -112/1-195 (Airport Expressway);
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Public Works Department is authorized{1} to issue a temporary road closure permit
to the FDOT for portions of the right-of-way of Northeast 37th Street, Northwest 37th Street Alley,
Northwest/Northeast 38th Street and Northwest 39th Street, within the City of Miami, Florida, as
described on the legal description, attached and incorporated, identified as Parcels 700, 702, 704,
705, 707 and 708, for an initial period of three (3) years, to accommodate the reconstruction of
portions of the SR -112/1-95 (Airport Expressway).

Section 3. The City Manager is authorized{1} to grant extensions to the initial three (3) year permit
period, in increments not to exceed ninety (90) days in duration.
Section 4. All fees required by the Code of the City of Miami, Florida, as amended, to obtain said
temporary road closure permit, and any extensions thereto, are waived.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
