Subject: Confirmation of the issuance of a Utility Excavation Permit to the Florida Department of
Transportation ("FDOT") in the right-of-way of Northwest 3`d Avenue.
Purpose of Item:
A Resolution confirming and clarifying the conditions of an Excavation Permit issued for the
installation, operation and maintenance of a utility conduit by the Florida Department of
Transportation ("FDOT") in the right-of-way of Northwest 3`d Avenue and to provide assurance that
the FDOT is authorized to continue to occupy the portion of the right-of-way with said utility conduit.
Background Information:
In accordance with City Code Section 54-42, the Public Works Department issued Excavation Permit
No. 1108 on June 26, 2008 for the installation of a utility conduit to be owned, operated and
maintained by the FDOT. The utility conduit is a component of a FDOT project that affects a portion
of the Northwest 3`d Avenue right-of-way, north of the SR -836/I-395 Expressway. The FDOT desires
clarification of the conditions for the issuance of the Excavation Permit and the assurance that the
FDOT is authorized to continue to occupy the right-of-way until such time that occupancy of the
right-of-way is not needed.
