A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR-FIFTHS
(4/5THS) AFFIRMATIVE VOTE, GRANTING AN INCREASED NUMBER OF CLASS
I SPECIAL PERMITS (BEYOND THE TWO (2) SPECIAL EVENTS ALLOWED PER
YEAR), FOR SOYKAS, LOCATED AT 5556 NORTHEAST 4TH COURT, MIAMI,
FLORIDA; SPECIFICALLY TO ALLOW A FARMERS' MARKET USE TO BE
ACCOMMODATED AT THE SOYKAS SITE, FOR A PERIOD OF SIX (6) MONTHS
COMMENCING ON NOVEMBER 1, 2009 THROUGH MAY 1, 2010, WITH
CONDITIONS AS STATED HEREIN.
WHEREAS, the applicable provisions of §906.9 of the Zoning Ordinance of the City of Miami,
Florida, as amended ("Zoning Code"), provide, in part, that (unless approved by a four-fifths (4/5ths)
affirmative vote of the City Commission waiving this requirement), no more than a total of two (2)
temporary events on private property per year, per site, may occur and further that the City
Commission may approve not more than a total of four (4) temporary events per site on private
property per year, by a four-fifths (4/5ths) vote or a single event for a duration of more than two (2)
weeks; and
WHEREAS, the City of Miami ("City") is committed to promoting neighborhood farmers market use
within the Upper Eastside area of the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, an increased number of Class I Special Permits
(beyond the two (2) special events allowed per year), is granted for Soykas, located at 5556 Northeast
4th Court, Miami, Florida, specifically to allow a farmers' market use to be accommodated at the
Soykas site for a period of six (6) months commencing on November 1, 2009 through May 1, 2010,
with such Class I being subject to review and approval by the Zoning Administrator as set forth in
Articles 13 and 14 of the Zoning Code.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
