See the attached plan for specific locations of these items. a. Entry grilllgate: For now, a temporary gate will be installed at the coral wall opening, to consist of chain link fence. This temporary gate will take the place of the entry grill specified on the architectural plans. b. Trail(s) improvements back to the main office will be realized by the City. Park and Recreation department. Includes the transition(s) between the new deck and the existing trails. c. Benches: The (3) new specified benches will not be installed at this time under this contract / scope, nor will the corresponding specified gravel beds. d. Additional signage inside the park. A bronze sign with the park history was already made and paid for. It is stored in the Simpson Park for future installation. Any other signage is excluded. e. Trash receptacles: to be provided and installed by the City f. Orchid's display inside the pavilion: The existing orchids on site Who Deadline Page 1 of 3 No. Topic Who Deadline will be moved to the Simpson House to protect them during construction. These orchids will then be placed in the completed Orchid Pavilion after construction. The remainder of the planned orchid display will not be installed at this time. g. FPL fees & other fees: We note in our exhibits exclusions to FPL fees, allowance to light fixtures (which will cost more), printing costs, misc., contingencies, etc. We will definitely incur some of these costs and shall be all taken care of within the final contract amount. h. Steel edging: The steel bed edging will not be installed on site. i. Sod: The specified sod will now be either 'Argentine Bahia' or 'Pensacola Bahia'- NOT 'St. Augustine Seville'. j. Light fixtures: The fixtures that were specified to be under the Lignum Vitae trees will be eliminated and will not be installed on site. 2. The following items were suggested to be left for a `Phase 3' and excluded in this contract / scope. 1. A permanent, attractive front gate for the orchid pavilion as suggested by the architects. 2. Additional benches for the park extension, to match the existing benches. 3. Parks and Recreation will look into getting attractive trash receptacles for the park. 4. The complete orchid display + mist system, as originally planned, can be installed as part of a Phase 3. 5. Educational signage for along the park trails should be considered as part of Phase 3. 3. Other suggestions are as follows: 1. Enea, upon start of construction, should submit a written scope of work to FPL to ensure all needed work is completed as necessary. 2. We could look at having an arts collective design and fabricate the final entrance gate, when we have the funds to do so. 4. Other agreements / clarifications: 1. We are ready to start construction. The revisions at the building department and DERM are complete and expecting contract execution on the City part as well as submittal of the Notice to Proceed from the City of Miami. We are mobilizing and incurring some expenses to be ready to start as soon as possible. 2. The Park extension in the front needed of additional funds Page 2 of 3 No. Topic _ Who Deadline (part of the additional fund raising efforts). Regardless of these funds not being raised as expected, Enea / Larqcon commit to create the extension to help move forward with the project. 3. Enea will scan in and email the approved construction drawings to Ted Baker, Maria Perez, and Sandra Vega for their review. 4. Parks team would like to review the landscape drawings once more before the construction starts 5. Parks and Recreation will purchase the crushed shell, and will apply this crushed shell to the hammock paths. Parks and Recreation will also construct the transitions from the path to the wood deck as specified in the plans - see construction drawing L-300 for specifications. Enea / Larqcon will not be responsible for this area of work. 6. Enea/Larqcon will sand and properly refinish the existing wood deck and benches. We will also correct or replace the warped/cupped wood boards. The City will not be responsible for this area of work. 7. Larqcon will submit a revised project budget / schedule of values to Sandra Vega for future payments processing. As discussed, Enea/Larqcon will possible handle internally some items of the project in order to reduce costs as oppose as being subcontracted to be able to carry on with the work and complete the project as planned. 8. All correspondences regarding Simpson Park should be cc'd to both Ted Baker and Sandra Vega, acting as representatives for Park and Recreation and CIP respectively. 9. Ola agreed that Larqcon will be able to request for payments every 2 weeks, not monthly as it normally happens. 10. Ola will check/confirm with Susanna for the additional funds to be donated by the homeowner associations in the area besides the $3K raised so far. All of the above, represents what was discussed and agreed during the meeting. If any party disagrees or has further comments that shall be recorded to the statements included herein, please contact the writer immediately to address and correct as necessary. Page 3 of 3
