AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED (THE "CODE"), TO AUTHORIZE THE
INCREASE OF VARIOUS FEES THROUGHOUT THE CODE; CONTAINING A
SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Miami ("City") has conducted a fee study analyzing the
City's fees and the associated cost to provide certain services; and
WHEREAS, the outcome of the fee study has demonstrated that the City's fee
schedule is outdated and does not reflect the proper fees; and
WHEREAS, based on these findings, the City of Miami City Commission ("City
Commission") authorizes the increase of various fees, as set forth in the Code of the City
of Miami, Florida, as amended (the "Code"), as set forth more particularly below.
NOW, THEREFORE, BE 1T ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Ordinance are adopted and incorporated as if fully set forth in this Section.
Section 2. Chapter 2 of the Code of the City of Miami, Florida, as amended
(the "Code"), is further amended in the following particulars:{1}

Sec. 2-207. Zoning certificate of use required; annual reinspection of buildings

(a) Inspection and service fees for certificate of use. All persons applying for a
certificate of use for the use of vacant or improved land or for a change of use of the
land or for a change in the use of an existing building shall pay the following inspection
and service fees:

(13) Change of name. A building or premises and/or part thereof shall be required to
obtain a new CU when a change in the name of the business or entity occupying space

therein has occurred. However, if no change in the use has occurred, the following fee

(c) Annual reinspection of buildings and premises:
(1) Annual reinspection certificates will be issued, and each existing use and/or
premises shall be inspected annually to determine that it complies with the provisions of
applicable ordinances and regulations.
(2) The owner will be notified of any deficiencies noted, and appropriate reinspections
may be made to determine that the deficiencies have been corrected.
(3) With the exception of life -safety facilities (which may be from time to time required
to be upgraded by the provisions of the South Florida Building Code or the city fire
code), only those regulations which were in effect at the time a particular occupancy or
use was established will be applicable.
(4) The invoice for the issuance of the annual reinspection certificate will be billed
during the year and said fees are herein fixed as follows:
a. Apartment building:

"Convenience stores," as used in this section, means any place of business that is
engaged in the retail sale of groceries, including the sale of prepared foods, and

gasoline and services, that is regularly opened for business at any time between the
hours of 10:00 p.m. and 5:00 a.m. and that is attended during such hours by one
employee. The term "convenience store" does not include a store which is solely or
primarily a restaurant. The term "convenience store" does not include any store in which
the owner and members of his family work in the store between the hours of 10:00 p.m.
and 5:00 a,m.

(5) When a reinspection is required due to continued life safety violations after the
second inspection by the department of fire -rescue, there shall be charged a fee of
$59.99 $53.00.
(6) Any renewal fee specified in subsection (c)(4) above, which is not paid by the due
date specified, will be considered delinquent and assessed a penalty of ten percent of
the current renewal fee plus an additional five -percent penalty for each month of
delinquency thereafter, until paid. However, the total delinquency penalty shall not
exceed 25 percent of the certificate of use fee for any annual period.
(d) Fees for accessory use certificates.
(1) All persons desiring to use a residential building structure located within a
residential zone permitting a home occupation shall apply to the planning, building and
zoning department for an accessory use certificate, which shall be granted upon
payment of an annual fee of $75.99 $79.00 to the city and when issued shall be valid
through the following September 30. In instances where a person 65 years of age or
over is engaged in the conduct of home occupation, there shall be no required payment
of an accessory fee in conjunction with the issuance of an accessory use certificate or
the subsequent renewal of such certificate. All renewals of accessory use certificates
shall be made on the subsequent renewal of such certificate or before October 1 of each
calendar year.
(2) Those owners of private pleasure craft and housebarges on the Miami River on
October 24, 1991, which qualify under sections 941 and 2502 of zoning ordinance No.
11000, shall apply to the building and zoning department for a housebarge/private
pleasure craft accessory use certificate, which subject to inspection and compliance with

applicable regulations, shall be granted upon the payment of an annual fee of $259-99
$263.00; all required renewals shall be made on or before January 1 of each year
hereafter.
(e) Zoning inspection.
(1) The City of Miami will provide, upon request of the owner or owner's agent, an on-
site inspection of properties within the City of Miami by the planning, building and zoning
department to ascertain whether zoning violations openly exist on the real property.
(2) The following fee shall be paid prior to each such inspection for each lot: zoning
inspection fee, $99.09 $84.00.
(3) A report on the results of each such inspection will be issued to the owner or
owner's agent and shall only constitute prima facie evidence of
compliance/noncompliance with the city's zoning ordinance and shall not be conclusive
proof of compliance/noncompliance with said zoning ordinance.
(4) Should a zoning violation be observed by a city zoning inspector during the course
of an on-site inspection, the property owner will be required to appear before the code
enforcement board of the City of Miami in regard to such violation no sooner than 30
days after said inspection, except as provided in Code section 2-814(c).
(f) There is hereby established a schedule of fees for reviewing plans on new
construction and inspecting new construction performed by the department of fire -
rescue; except for single-family and duplex residents:
(1) Minimum fee ... $59.99 $53.00

Sec. 2-208. Fee for inspections and examinations of plans for compliance with the
provisions of the City of Miami zoning ordinance.
(a) There is hereby established the following fee per square foot of total land area
encompassed in the project at the time the application is made for the construction of a
new building, change of use of building, or an addition (proportional part of land area),
for the purpose of examination of the plans and site development and subsequent
inspections of the building site prior to the issuance of the certificate of occupancy and
subsequent thereto to assure original and continued compliance with the provisions of
the city zoning ordinance, Ordinance Number 11000:
Single-family and duplexes ... $8-899 $0.01

DIVISION 4. PUBLIC WORKS DEPARTMENT
Sec. 2-268. Fee for preparation of documents containing covenants to run with
the land, waiver of fee; fee for preparation of documents allowing the use of public
right-of-way by private entities; recording fee.
(a) For the preparation and processing of any legal document running with the land
covenanting the construction or postponement of construction of a public works
improvement either in the public right-of-way or on private property, a fee of $299-90
$210.00 shall be collected by the director of public works. The fee required under this
subsection may be waived for governmental entities and agencies.
(b) For the preparation and processing of legal documents allowing the use of public
right-of-way by private entities, excluding permits and those documents described in
subsection (a) hereinabove, a fee of $259-99 $263.00 shall be collected by the director
of public works.
(c) In addition to the above fees, the party proffering the legal document shall also pay
the recording fee, as established by the state.
Sec. 2-269. Checking and recording plats and alley closures or vacations --Fee
schedule; waiver of fee.
(a) The fees to be charged by the public works department for processing tentative
plats and recording plats submitted for approval of the city, including the inspection of
the permanent reference monuments set in the field, are hereby fixed as follows:
(1) Recording plat:
a. To accompany tentative plat application ... $380-98 $315.00

for completion of subdivision improvements required in conjunction with a recorded plat .

(b) The processing fees required by paragraphs (1) and (2) of subsection (a) shall be
waived for governmental entities and agencies.
(c) The fees to be charged for an expedited review for processing tentative plats and
recording plats submitted for approval of the city, including inspection of the permanent
reference monuments set in the field, are fixed as follows:
Outside source review fee: Actual cost plus 4-5 20 percent administrative fee for
processing.
(d) Fees to be charged pursuant to subsections 55-15(i) and 55-150) providing for an
alternative method for the closure or vacation of alleys which abut parcels of land zoned
solely residential.

Section 3. Chapter 10 of the Code is further amended in the following
particulars: {1}
"CHAPTER 10. BUILDINGS
ARTICLE 1. IN GENERAL
Sec. 10-4. Building permit fee schedule.
(a) Fee for work without permit. When work is commenced prior to obtaining a required
permit, a fee of two times that specified in this section plus $499-88 $105.00 shall be
paid. The payment of such fees shall not relieve any person, firm, or corporation from
fully complying with all of the requirements of all applicable regulations and codes, nor
shall it relieve them from being subject to any of the penalties therein. The fee
requirement shall be applicable to all divisions of the building department.
(b) General fees; minimum fee.
(1) Solid waste surcharge.
a. Building permits.
Residential: $8-2-8 $0.21 per $100.00 of the estimated cost of construction with a
minimum fee of $25.99 $26.00 and a maximum fee of $599.99 $525.00.
Commercial: Permits for a building whose estimated construction cost is under
$1,000,000.00: Twe peFGeRt Two and a half percent of the cost of construction with a
minimum of $58-88 $53.00 and a maximum of $5,989.99 $5.250.00.

Permits for a building whose estimated construction cost is equal to or over
$1,000,000.00: Two percent of the cost of construction with a minimum of $59-09 $54.00

b. Master electrical, mechanical, and plumbing permits.
Residential: $872-9 $0.21 per $100.00 of the cost of construction on all master electrical,
mechanical and plumbing permits with a minimum fee of $25.08 $26.00 and a maximum
fee of $589.90 $525.00.
Commercial: " $0.21 per $100.00 of the cost of construction on all master electrical,
mechanical and plumbing permits with a minimum fee of $59.09 $54.00 and a maximum
fee of $2,599.90 $2.625.00.
c. Exemptions: The following permits are exempt: sign, landscape, elevator, revisions,
residential painting permits, subsidiary permits (i.e., permits issued under the master
permit plan number), building roofing, awning, door, window, shed, floor covering and
driveway. Affordable housing shall be exempt providing that proper certification from the
director of the community development department is presented at the time plans are
reviewed.
(2) Reinspection fees. For each reinspection, except where otherwise noted, $--59-08
$54.00, when extra inspection trips are necessary due to:
a. Wrong address being given on call for inspection;
b. Rejection of work due to faulty construction;
c. Work not being ready for inspection at time specified;
d. Failure to call for final or other inspections;
e. Required corrections not being made at time specified;
f. No approved plans at the building site.
The payment of reinspection fees may be required before any further permits will be
issued to the person or firm owing same, and further inspections may be refused until
payment of reinspection fees has been made.
(3) Reinspection of existing buildings and inspection for certificate of compliance fee.
Reinspection of existing buildings (by all sections) to determine compliance with the
South Florida Building Code, the City of Miami Zoning Ordinance and other applicable
ordinances (but not the annual inspection as required by section 2-87(c)) and inspection
of existing buildings after repairs, alterations or remodeling for a certificate of
compliance, when a certificate of occupancy is not required:
Each building up to two stories and not exceeding 20,000 square feet . . . $-259.08

person, firm or corporation from fully complying with all of the requirements of all
applicable regulations and codes, nor shall it relieve them from being subject to any of

(c) Refunds, time limitation, revocation, etc. The fees charged pursuant to this
ordinance, provided the same are for a permit required by Section 301.1 of the South
Florida Building Code, may be refunded by the Director of the Building and Zoning
Department, subject to the following:
(1) No refunds shall be made where any work has commenced except where duplicate
permits are issued for the same work, in which case a refund in accordance with
subsection (4), below, may be granted to the original permit holder providing that the
duplicate permits were issued within 90 days of each other and request for refund is
received within 90 days of the issuance of the latter permit.
(2) No refunds shall be made where a permit has become void as provided by
paragraph 304.3(a) of the South Florida Building Code.
(3) No refunds shall be made on permit fees of X498-99 $105.00 or less.
(4) Refunds on permits or any item thereon, where fees are over $199.99 105.00 will
be refundable on a basis of 50 percent of the balance over $100.00 such refunds be
made to the closest dollar.
(5) Full refunds may be granted to a permit holder whose permit is canceled by owner
authorization where work has commenced and such owner selects a second contractor
to complete the work. The second contractor shall pay a full fee to complete the work
unless the first contractor waives his/her opportunity to refund in writing, or if the
property owner can provide proof that the first permit holder was reimbursed for the
permit fee, in which case the second contractor is entitled to a permit to cover the same
work on a "no charge" basis. If the first payment is expired the second contractor shall
pay a full permit fee on unstarted work or a completion permit fee in accordance with
subsection (d)(16)b, below.
(6) A full refund may be granted to a permit holder who takes out a permit covering
work outside the jurisdictional inspection area, or if permit is canceled by the department
within 90 days with no work being done.

Sec. 19-2.1. Fire safety permit requires(; issuance; fees; annual renewal;

(b) Fire safety permits issued for occupancy of buildings or premises or part thereof.
(1) Persons holding certificates of use. Within 30 days of the effective date of this
ordinance the city shall mail an invoice requiring the payment of the fire safety permit
fee, in accordance with the fee schedule set forth in this subsection, to all persons
holding a certificate of use issued by the city's building and zoning department. Upon
payment of the required fee the department of fire -rescue shall issue the fire safety
permit.
(2) Persons applying for certificates of use. All persons applying for a certificate of use
shall concurrently with such application make an application for a fire safety permit to the

annual fire safety permit renewal certificate will be billed during the year. Upon payment
of the fee, the annual fire safety permit renewal certificates will be issued by the
department of fire -rescue. The owner of the building or the premises or part thereof,
and/or the permit holder shall be notified of any deficiencies noted, and appropriate
reinspection may be made to determine whether or not the deficiencies have been
corrected. When a reinspection is required due to continuing life safety violations after
the second inspection by the department of fire -rescue, there shall be charged a
reinspection fee of $59.99 53.00.
Sec. 19-3. Places of assembly; permit required; fees.
(b) No place of assembly which has received approval and local business tax receipts
to operate for one purpose shall change the use of the occupancy for any other
assembly purpose without first obtaining a permit from the department of fire -rescue for
such use. The cost of the permit shall be $55.99 58.00.
Sec. 19-5. Flammable and combustible liquids; permits; fees; inspections.
(c) Permit fee. The permit fee shall be $55.99 58.00 per tank for all tanks of 60 gallons
capacity installed aboveground or belowground.
Sec. 19-6. Explosives.
(d) Permit fees. The cost of the permit fee for explosive demolition of any structure
shall be $3999 347.00 and shall be paid at least 30 days in advance of any such
proposed blasting at a single location.
Sec. 19-7. Manufacture, sale, time of display and discharge of fireworks.
(a) Manufacture prohibited. The manufacture of fireworks is prohibited within the city.
(b) Permits required for supervised public displays. Except as hereinafter provided, it
shall be unlawful for any person to store, to offer for sale, expose for sale, sell at retail,
use or explode fireworks within the city, provided that the director of the department of
fire -rescue may adopt reasonable rules and regulations for the granting of permits for
supervised public displays of fireworks by municipalities, organizations or groups of
individuals. Such permits may be granted upon:
(1) Application to the director of the department of fire -rescue to be held as provided
herein; and
(2) The filing of a bond by the applicant as provided herein.
Every such display shall be handled by a competent operator licensed or certified as to
competency by an acceptable reference and shall be of such composition, character and
so located, discharged or fired as, in the opinion of the director of the department of fire -
rescue after proper inspection, not to be hazardous to property or as not to endanger
any persons. The director of the department of fire -rescue is authorized to refuse to

issue any permit when he/she finds the public safety would be endangered. The cost of
the permit fee shall be $55.99 53.00.
Sec. 19-9. Special off-duty fire -rescue services.
(a) The director of the department of fire -rescue, and the fire marshal, or their
designees, shall cause the requests for off-duty fire -rescue personnel to provide services
to persons or businesses requesting the same to be evacuated on the basis of the
reasonableness thereof, included in such evaluation, factors of existing laws,
ordinances, rules and regulations, personnel scheduling availability, risk of harm to
personnel and department efficiency.
(b) As a fee payable to the city to offset the costs of administering the herein off-duty
fire -rescue services program, the director of the department of fire -rescue shall cause to
be collected and shall establish procedures for the collection by the city of a sum of

per hour for a fire lieutenant, $84.25 per hour for a fire captain and $92.67 per hour for a

employment of off-duty fire -rescue personnel by private persons or firms. This fee shall
be in addition to the hourly compensation rate payable by such private persons or firms
to the individual fire -rescue representative. The monies received hereunder by the city
shall be placed in the general fund except that $2.40 of each fee collected shall be
placed in the city self-insurance and insurance trust fund.
Section 5. Chapter 22 of the Code is further amended in the following
particulars:{1}
"CHAPTER 22. GARBAGE AND OTHER SOLID WASTE
ARTICLE Il. REGULATION OF PERSONS ENGAGED IN COMMERCIAL WASTE
COLLECTION
Sec. 22-50. Franchise fees; permit per account fees(s); annual franchise fee;
annual specialized waste handling fee.
(a) Each and every franchisee shall pay a permit per account fee annually of $50.99
75.00 for each account and each roll -off effective October 1 st of every new fiscal year to
those accounts and roll -offs booked as of October 1st of every new fiscal year with
whom they contract for the provision of commercial solid waste services and/or
specialized waste handling services, including each container and/or roll -off utilized by
franchisee in the course of providing solid waste services. The franchisee may only pass
on an amount not to exceed $24-99 38.00 of said permit per account fee to each
contracted customers. Said permit per account fee shall not be transferable. Effective
October 1, 2004 the annual period will begin October 1st and end September 30th.

(b) Beginning October 1- 8, 2884 2009, each and every franchisee shall pay an annual
franchise fee by October 1 each year of the franchise term (and of any extension
thereof) in the iRit+af amount of $5,C)N48 7,500.00, with such franchise fee being
increased by $500.00 per year beginning October 1, 2-885 2010. Failure to remit the
required annual franchise fee by the due date shall result in a one and one-half percent
penalty per month on the balance due.
(c) Beginning October 4 8, 2-994 2009, each and every franchisee whose primary
business is limited to solid waste that requires special handling and management shall
pay an annual specialized waste handling permit fee by October 1 each year of the
franchise term (and of any extension thereof) in the amount of $1;998-99 3,500.00 for
the right to provide only specialized waste handling services within the city limits. If a
franchisee is providing only specialized waste handling services within the city, then
annual franchise fee will increase by $500.00 per year beginning October 1, 2895 2010.
Failure to remit the required annual franchise fee by the due date shall result in a one
and one-half percent penalty per month on the balance due.
(d) Certified recovered materials dealers excluded from local franchise requirements
pursuant to § 403.7046, Fla. Stat. shall be required to pay a registration fee as
determined by the director of the department for an annual period which will begin
October 1st and end September 30th of each year.
Sec. 22-56. Franchise fee requirement; monthly franchise fee payment; approval
by director as a prerequisite to issuance; financial statements, list of accounts;
account permit fees; roll -off permit fees.
(b) Effective October 1, 1994, all city -franchised commercial solid waste haulers will be
required to pay to the city a franchise fee of eight percent of the franchisee's monthly
total gross receipts. Said franchise fee shall be increased to 12 percent effective October
1, 1995, and to 15 percent effective October 1, 1996. Said franchise fee shall be further
increased to 22 percent, effective October 1, 2004 Said franchise fee shall be further
increased to 24 percent, effective October 8, 2009. The franchisee shall, on or before
the last day of each month, deliver to the city finance department a true and correct
statement of gross receipts generated during the previous month from its services
rendered within the city on or before the last day of each month. Payments of said fee
shall be made on a monthly basis to the city finance department, on or before the last
day of each month, representing gross receipts collected the previous month. The
franchisee shall on or before 60 days following the close of each fiscal year deliver to the
director a statement of its annual gross receipts generated from accounts within the city
prepared by an independent certified public accountant reflecting gross receipts within
the city for the preceding fiscal year. The franchisees will allow city auditors, during
regular business hours after reasonable notice, to audit, inspect and examine the
franchisees' fiscal books and records and tax returns, insofar as they relate to city
accounts, to confirm the franchisees' compliance with this section. In the event the
franchisee fails to pay the full franchise fee percentage of the franchisee's total monthly
gross receipts, the city shall charge a penalty of one and one half percent per month on
the outstanding balance until paid and additionally the franchisee shall have to pay all
expenses of collection, including court costs and reasonable attorneys fees.
(c) To effectively provide for the payment of said franchise fee by the franchisees to the
city, any person seeking to renew his annual local business tax receipt pursuant to the

provisions of chapter 31 of this Code shall, in addition to the requirements set forth
therein, provide the city finance department with evidence of all fees imposed by the
provisions of this chapter as a condition to reissuance or renewal of said business
permit.
(d) Issuance of a franchise shall require completion of an application form for the
franchise referenced in section 22-47 of this chapter.
(e) The director is authorized to suspend, revoke, or cancel any such franchise for
failure to comply with any of the terms hereof, in accordance with the same practice and
procedures as are set forth in section 22-48 of this chapter; providing, however, that the
director shall afford an existing franchisee a written notice reasonably specifying the
reason(s) for the proposed revocation or suspension of an existing franchise, and the
franchisee shall be afforded five business days to cure the noncompliance stated in such
notice.
(f) Any decision of the director under the terms of this section may be reviewed, upon
written request of the aggrieved franchisee made to the city manager in accordance with
the same time period and procedure as are set forth by section 22-49, City Code.

(b) The monthly on -street permit program is available, in certain areas
of the City, pursuant to this Chapter, on a first-come, first -serve
space available basis. Permits are to be issued by the
Department of Off -Street Parking. The Exec-ti���GtGF Chief
Executive Officer ("Director") is expressly authorized to implement
this program and shall oversee and develop these special on -
street parking permit areas as they are deemed necessary by the
Director where the Director determines that sufficient off-street
parking facilities are not available in an area to accommodate
monthly parking demand. Such areas will be subject to all
applicable laws, resolutions, rules and guidelines governing their
operation established by the City Commission and/or
Board/Department Of Off -Street Parking. All monthly parking
patrons are required to renew and pay for their monthly parking
permits, in advance, no later than the third day of each month. If
payment in full is not received by the third day of the month, then
the permit is automatically invalidated without the necessity of
further action. Monthly on -street parking permits for these special
parking areas can be purchased for up to 12 months at a time. At
no time shall such parking permits be sold for a period longer than
12 months, unless a longer time period has been allowed by law.
(c) City of Miami employees who reside within the City will be able to
receive a twenty -percent (20%) discount towards the purchase of
one monthly permit (1 permit), as long as they remain eligible.

(b) All off-street parking lot rates exclude parking surcharge and all
applicable sales taxes. These rates may be increased by
resolution of the Off-street Parking Board to a maximum of three -
percent (3%) annually in any individual fiscal year. The increase
shall not exceed an accrued annual rate of 3%.
(c) City of Miami employees who reside within the City will be able to
receive a twenty -percent (20%) discount for the purchase of one
(1) monthly parking permit, as long as they remain eligible. Each
additional permit will be purchased at the regular price.
(d) The following fees will be assessed during special events, film
production and construction uses for Off-street parking garage
rental within the above garages:
a. $20.00 administrative fee assessed for any meter rental of five
(5) meters or less.
b. $25.00 administrative fee assessed for any meter rental of six
(6) to ten (10) meters.
c. $30.00 administrative fee assessed for any meter rental of
eleven (11) meters or more.
(e) The rate of charge $10 per off-street parking garage, per day, plus
sales tax, if applicable will be assessed during special events, film
production and construction uses for within the above garages.
Sec. 35.194. Metered Space Rentals; Bagged Meter Fees.; on
street non metered Space rental
(a) The rates and fees charged for metered space rentals, bagged
meters and on street non- metered Space rental are as follows (all rates
exclude parking surcharge and all applicable sales tax):
(1) Administrative Processing Fees:
The administrative fees for the processing of all metered parking space rental
permits are set forth herein and may be amended from time to time, by the City
Commission. The administrative fee is in addition to any fee paid for parking
stalls, meter bags, or linear curb space.
The Administrative Fee structure is as follows:
a. $20.00 administrative fee assessed for any meter
rental of five (5) meters or less.
b. $25.00 administrative fee assessed for any meter
rental of six (6) to ten (10) meters.

c. $30.00 administrative fee assessed for any meter
rental of eleven (11) meters or more.
(2) Bagged Meter Fees:
The rate is $� 9815.00 per meter, or for every twenty linear feet, per day. The
fees are set forth herein and may be amended from time to time by the City
Commission.
Section 7. If any section, part of a section, paragraph, clause, phrase or word
of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall
not be affected.
Section 8. This Ordinance shall become effective immediately upon its
adoption and signature of the Mayor.{2}
