HomeMy WebLinkAboutExhibit 2 SUBecl 01 Attachment A - Scope of Services Negotiate, procure and implement the operation of an "Owner Controlled Insurance Program ("OCIP") for the City's Parking Garage Project ("Project"). These duties shall include, but not be limited to: 1. Provider's Insurance/Claim Responsibilities: Act as the City's insurance broker to assist in the design, negotiation and placement of all insurance policies with insurers in connection to the OCIP. The Provider will assess the City's risks relating to the Project, identify and prioritize the risks and analyze the risk exposure in accordance with the terms and conditions of the Professional Services Agreement. In designing the OCIP Program, the Provider will identify the appropriate coverages for the Project with appropriate liability limits. The Provider will also recommend coverage enhancements. The provider will assist in negotiating and placing coverage for the OCIP Program on behalf of the City in accordance with the Professional Services Agreement. Once design, negotiation and placement of all insurance is obtained, the Provider will also perform the following duties in connection with the OCIP and the Project claims, including but not limited to: • Require the chosen carrier to provide on-line claims access to all loss data reported under the OCIP program • Establish relationships with local occupational health clinics to ensure medical attention in a cost-effective manner • Review each loss reported under the OCIP program to ensure adequate reporting • Monitor the carrier's claims activity on each file to ensure complete investigation of the claim by the carrier. • Monitor all activities, including financials, involving the adjustment of claims to ensure a timely and cost-effective conclusion • Monitor and advise the City of coverage applications for specific claims • Work with the carrier in the selection of expert panel claims counsel to participate in claims involving litigation against the project • Develop claims coordination procedures for any multiple -insurer resolutions. • Monitor reporting on all serious claims and coordinate efforts with all corresponding carriers, primary and excess, to insure adequate handling and resolution • Participate in all claims audits and or claims reviews with the insurance carrier P-r-ovide--detailed-audit-re,po-.rts-and per-for-rnance.anal-y-si-s-reports • Provide reports regarding savings generated by PPO network, utilization review and medical bills audit • Provide reports generating recoveries obtained through deductible and means of subrogation Page 3 of 6 206164 2, Provider's Administrative Responsibilities under the OCIP • Assist the City or its representatives in preparing bid materials and attend bid meetings as necessary • Monitor the daily operations of the OCIP Administrator as selected by the Provider in connection with The Project • Hire, supervise and monitor all activities of the Project Administrator and/or Sub -consultant, including Project Safety Manager, Contractor and Subcontractor involved in the OCIP. These activities include, but are not limited to conducting site safety inspections daily • Work with the City to develop the Project safety requirements, site safety plan or manual • Participate in the orientation meetings for all OCIP participants and enrolled contractors • Provide orientation safety training by a qualified Site Safety Manager (includes applicable OSHA requirements) • Organize and participate in monthly project safety committee meetings • Coordinate and participate in Contractor/Sub-contractor weekly safety meetings • Participate in job safety analysis for operations likely to have significant exposures to injury • Confirm that those trades requiring "Competent Persons" such as excavation and scaffold erectors, have personnel who meet the training and knowledge requirements of those designations • Confirm that equipment operators have required licenses or certificates • Confirm that inspection records for heavy equipment are up to date • Implement a well coordinated and detailed claims reporting program which will be communicated to all parties involved in the OCIP. This will include early intervention procedures to be followed in the event of a claim involving serious injuries • Conduct periodic loss control inspections to monitor enrolled contractor compliance with Project safety standards 3. General Services • The Provider shall act in the City's best interests at all time in providing services —T-lre-Provi-der-shall-be-authorized-to-representand-assist-tlre City-iirail- iscussion and transactions with all insurers, provided that Provider shall not place any insurance on behalf of the City unless so authorized by the City • The Provider shall assign sufficient numbers of duly qualified personnel to the Services to the extent necessary to ensure that its obligations are timely carried Page 4 of 6 206164 out with the respect to the performance of the Services.
