Purpose of Item: The Administration recommends that the Miami City Commission adopt the attached Resolution authorizing the City Manager to execute a Grant of Easement, in substantially the attached form, on City -owned property located at Elizabeth Steele Park at 3525 E. Fairview Street, Miami, Florida, to Florida Power & Light, a Florida Corporation ("FPL"), as more particularly described in Exhibit "A" attached hereto and made a part hereof, to construct, operate, and maintain underground electric utility facilities, with the right to reconstruct, improve, change and remove all or any portion of the facilities within the easement. Director Chief'__L: �L /,/L City Manager, Page 1 of 2 SUPPLEMENTAL SHEET Subject: Resolution Granting an Easement to Florida Power & Light located on City -owned property at 3525 E. Fairview Street, Miami, Florida (also known as Elizabeth Steele Park). Background Information: The City Commission approved a Major Use Special Permit ("MUSP") for the Hiawatha Village ("Project") on June 22, 2006, Resolution No. 06-0404. Pursuant to the conditions of the MUSP approval, the applicant, Chateau Apartments, LLP of the adjacent project, had to meet certain conditions in cooperation with the Fairview Neighbors petition which included providing improvements to Elizabeth Steele Park including, but not limited to, the installation of lighting fixtures to serve the park. In order to install and maintain the utilities, Florida Power & Light ("FPL") requests an easement of a ten (10) foot wide by approximately four -hundred two (402) foot long strip permanent, non-exclusive easement on City -owned property located at Elizabeth Steele Park at 3525 E. Fairview Street, Miami, Florida. This grant of Easement will be used to construct, operate, maintain, and/or remove such electric facilities. All new utility lines are to be buried underground.
