EARLY VOTING IN THE CITY OF MIAMI, PURSUANT TO FLORIDA STATUTE
§100.3605, FOR THE MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 3,
2009; DESIGNATING CERTAIN SITES AND TIMES FOR EARLY VOTING;
CONTAINING A SEVERABILITY CLAUSE, AND PROVIDING FOR AN IMMEDIATE
EFFECTIVE DATE.
WHEREAS, Florida Statute §101.657 provides for early voting in the various locations in
Florida; and
WHEREAS, the municipal election to be held on November 3, 2009, in the City of Miami is not
in conjunction with county or state elections; and
WHEREAS, Florida Statute §100.3605 allows for a municipality to conduct early voting so long
as it does not conflict with the Florida election code;
NOW, THEREFORE, BE 1T ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. The City Commission shall have early voting in the City of Miami for the municipal
election to be held on November 3, 2009, in the following designated sites and times as set forth
herein.
Early Voting Sites:
1) Allapattah Branch Library, 1799 Northwest 35th Street
2) Lemon City Branch Library, 430 Northeast 61st Street
3) Miami City Hall, 3500 Pan American Drive
4) West Flagler Branch Library, 5050 West Flagler Street
5) Stephen P. Clark Building, 111 Northwest 1st Street
Dates and Times:
Monday - Friday, October 26, 2009 through October 30, 2009 - 7:00 a.m. - 7:00 p.m.

Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately after final reading and adoption
thereof.(1)

Footnotes:
{1} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
{2} If the Mayor does not sign this Ordinance, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission.
