HomeMy WebLinkAboutLegislationFile Number: 08-00678b Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE PLACEMENT OF A BILLBOARD AT GRAPELAND PARK; AUTHORIZING THE CITY MANAGER TO EXECUTE A LICENSE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH CBS OUTDOOR, INC., AND ALL NECESSARY DOCUMENTS FOR THIS PURPOSE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY. WHEREAS, pursuant to Section 38-66 of the Code of the City of Miami, Florida, as amended, the City of Miami ("City") has approved placing outdoor advertising signs ("Signs") within City parks; and WHEREAS, the City seeks to place one (1) Sign within Grapeland Park, located at 1802 Northwest 37th Avenue, Miami, Florida; and WHEREAS, although the proposed location for the Sign is Grapeland Park, the zoning in the proposed location is not that of a City Park; and WHEREAS, the City Parks and Recreation Committee, on July 16, 2009, recommended against placement of the one (1) Sign listed above within City property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Commission authorizes the placement of one (1) Sign within City property, specifically in Grapeland Park; located at 1802 Northwest 37th Avenue, Miami, Florida; Section 3. The City Manager is authorized{1} to execute a License Agreement with CBS Outdoor, Inc., in substantially the attached form, as "Exhibit A", and all necessary documents for this purpose, in a form acceptable to the City Attorney. Section 4. BRU CITY ATTORNEY `yt Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
