HomeMy WebLinkAboutLegislation"of City of Miami s Legislation Resolution File Number: 08-00678a City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE PLACEMENT OF BILLBOARDS WITHIN PARK LIMITS AT JOSE MARTI PARK, ROBERT KING HIGH PARK, AND OVERTOWN PLAZA; AUTHORIZING THE CITY MANAGER TO EXECUTE LICENSE AGREEMENTS, IN SUBSTANTIALLY THE ATTACHED FORMS, AS "EXHIBITS A" THROUGH "C", WITH CBS OUTDOOR, INC., AND ALL NECESSARY DOCUMENTS FOR THIS PURPOSE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY. WHEREAS, pursuant to Section 38-66 of the Code of the City of Miami, Florida, as amended, the City of Miami ("City") has approved placing outdoor advertising signs ("Signs") within City parks; and WHEREAS, the City seeks to place three (3) Signs within City parks, specifically in Jose Marti Park, located at 434 Southwest 3rd Avenue; Robert King High Park, located at 7025 West Flagler Street; and Overtown Plaza, located at 1490 Northwest 3rd Avenue, Miami, Florida; and . WHEREAS, the City Parks and Recreation Committee, on July 16, 2009, recommended against placement of the three (3) Signs listed above within City parks; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Commission authorizes the placement of three (3) Signs within City parks, specifically in Jose Marti Park, located at 434 Southwest 3rd Avenue; Robert King High Park, located at 7025 West Flagler Street; and Overtown Plaza, located at 1490 Northwest 3rd Avenue, Miami, Florida. Section 3. The City Manager is authorized{1) to execute License Agreements with CBS Outdoor, Inc., in substantially the attached forms, as "Exhibits A" through "C", and all necessary documents for this purpose, in a form acceptable to the City Attorney. Section 4. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
