A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "USEPA
NATIONAL CLEAN DIESEL FUNDING ASSISTANCE PROGRAM" AND
APPROPRIATING FUNDS, CONSISTING OF A GRANT AWARDED FROM THE
UNITED STATES ENVIRONMENTAL PROTECTION AGENCY, IN AN AMOUNT
NOT TO EXCEED $731,850, TO ACQUIRE BIODIESEL REFUSE HAULERS FOR
THE CITY OF MIAMI'S ("CITY'S") BIODIESEL FLEET CONVERSION;
AUTHORIZING THE CITY'S REQUIRED MATCHING FUNDS, IN THE AMOUNT
OF $2,195,550, FROM CAPITAL IMPROVEMENT PROJECT MACHINERY AND
EQUIPMENT ACCOUNT NO. 39000.213000.664000.0000.00000; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, AND ANY NECESSARY DOCUMENTS
IN ORDER TO IMPLEMENT THE ACCEPTANCE AND ADMINISTRATION OF SAID
GRANT AWARD.
WHEREAS, the City of Miami ("City") has a strong interest in reducing diesel emissions and
improving air quality for the use and enjoyment of its residents and visitors; and
WHEREAS, in October, 2008, the City Commission unanimously adopted MiPlan, the City's
Climate Action Plan, that specifically promotes the use of alternative fuel, such as biofuel, for its
vehicles; and
WHEREAS, the City has been awarded a grant from the United States Environmental Protection
Agency, in an amount not to exceed $731,850, related to reducing diesel emissions and for the
replacement of refuse haulers; and
WHEREAS, the City has identified the required matching funds in the amount of $2,195,550, from
the Capital Improvement Project ("CIP") Machinery and Equipment Account No.
39000.213000.664000.0000.00000); and
WHEREAS, it is appropriate for the City Manager to accept said grant and to establish a new
special revenue project for the appropriation of said grant award;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The following new Special Revenue Project is established and resources are
appropriated as described below:

Section 3. The City Manager is authorized {1 } to execute the Agreement, in substantially the
attached form, and any necessary documents in order to implement the acceptance and administration
of said grant award.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
