A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ADOPTING AN IDENTITY THEFT PREVENTION PROGRAM IN COMPLIANCE
WITH FEDERAL REGULATIONS RELATING TO THE FEDERAL TRADE
COMMISSION'S RED FLAG RULES.
WHEREAS, the Federal Trade Commission has issued regulations requiring financial
institutions and creditors to develop and implement written identity theft prevention programs under the
Fair and Accurate Credit Transaction Act ("FACTA") of 2003; and
WHEREAS, the FACTA rules require that financial institutions and municipalities, as creditors,
and other creditors that hold any consumer account or other account for which there is a reasonably
foreseeable risk of identity theft, to develop and implement an identity theft prevention program for
combating identity theft in connection with new and existing accounts; and
WHEREAS, the identity theft prevention program must contain reasonable policies and
procedures to identify relevant red flags for covered accounts and incorporate those red flags into the
identity theft prevention program, detect red flags that have been incorporated into the identity theft
prevention program, respond appropriately to any red flags that are detected to prevent and mitigate
identity theft, ensure the identity theft prevention program is updated periodically to reflect changes in
risks to customers or to the safety and soundness of the City of Miami ("City") from identity theft; and
WHEREAS, the City has created an identity theft prevention program that complies with the
new requirements; and
WHEREAS, the identity theft prevention program must be adopted by the City Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The City of Miami's Identity Theft Prevention Program is hereby adopted in
compliance with Federal Regulations relating to the Federal Trade Commission's Red Flag Rules.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor. {1}

Footnotes:
(1) if the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City.
