A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO INSTITUTE A "USE IT OR LOSE IT" POLICY FOR ALL
UNCLASSIFIED EMPLOYEES PRECLUDING THE ACCRUAL OF CERTAIN
BENEFITS, SPECIFICALLY COMPENSATORY TIME, SICK TIME, VACATION TIME,
AND OTHER RELATED BENEFITS, AND TO PROVIDE THE CITY COMMISSION A
REPORT OF SAID ACTION BEFORE ITS IMPLEMENTATION.
WHEREAS, the City Manager has the necessary authority to modify the compensation
and benefits package for approximately 14% of the city's workforce whose compensation and
benefits package is not governed by a collective bargaining agreement; and
WHEREAS, the City's current benefits policy allows for the annual accrual of certain
benefits, including but not limited to, compensatory time, sick time, and vacation time, for
unclassified employees; and
WHEREAS, the accrual of such benefits creates a significant, recurring financial liability for
the City and its residents;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby directed to institute a "use it or lose it" policy for all
unclassified employees precluding the accrual of the aforementioned benefits and to provide
the City Commission with a report summarizing the revised policy before its implementation.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
