HomeMy WebLinkAboutLegislationFile Number: 09-01010 City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING THE AWARD TO D'LALY CATERING CORPORATION, PURSUANT TO INVITATION FOR BID NO. 122066; AND AWARDING THE BID TO GREATER MIAMI CATERERS, INC., THE SECOND LOWEST RESPONSIVE AND RESPONSIBLE BIDDER FOR THE PROCUREMENT OF AFTER SCHOOL SNACKS ON AN AS -NEEDED CONTRACTUAL BASIS, FOR AN INITIAL CONTRACT PERIOD OF ONE (1) YEAR, WITH THE OPTION TO RENEW FOR TWO (2) ADDITIONAL ONE (1) YEAR PERIODS; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF FUNDS OF THE USER DEPARTMENT, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED. WHEREAS, pursuant to Resolution No. 09-0082, adopted February 26, 2009, the Miami City Commission awarded a bid to D'Laly Catering Corporation, for the procurement of Snacks for After School Program on an as needed contractual basis, for an initial contract period of one (1) year, with the options to renew for two (2) additional one (1) year periods; and WHEREAS, in a letter dated August 3, 2009, D'Laly Catering Corporation has notified the City of Miami that it is no longer in business and therefore unable to continue supplying the goods and services contracted under Invitation for Bid 122066, Snacks for After School Program; and WHEREAS, the second lowest bidders, David's Food & Fun, Inc., d/b/a Dixie Catering and Greater Miami Caterers, Inc., are tied at $0.88 per after school snack; and WHEREAS, pursuant to Section 2.16, "Tie Bids", of Invitation for Bid No. 122066, "Snacks for After School Program", "a Bid received from a business that certifies that it has implemented a drug-free workplace program shall be given preference in the award process"; and WHEREAS, the Purchasing Department has confirmed that only Greater Miami Caterers, Inc., has implemented a drug-free workplace program and is therefore recommending the award to Greater Miami Caterers, Inc., the second lowest responsive and responsible bidder per bid specifications; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The award to D'Laly Catering Corporation, pursuant to Invitation for Bid No. 122066, is rescinded, and the bid is awarded to Greater Miami Caterers, Inc., the second lowest responsive and responsible bidder, for the procurement of Snacks for After School Program, on an as needed contractual basis, for an initial contract period of one (1) year, with the option to renew for two (2) City of Miami Page 1 of 2 Printed On: 9/9/2009 File Number. 09-01010 additional one (1) year periods, with funds allocated from the various sources of funds of the user department, subject to the availability of funds and budgetary approval at the time of need. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS' JULIE 0. BRU CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
