Subject: An Ordinance amending the City Code regarding the issuance of permits for construction and the use
of public right-of-way.
Purpose of Item:
The purpose of this Ordinance is to amend Chapters 17 and 54 of the City Code to update the
requirements for the issuance of construction and right-of-way use permits issued by the Public
Works Department to conform to new land management and electronic permitting procedures that
will be available on the internet and to clarify the extent of construction, maintenance and repair
responsibility by property owners for roadway improvements.

Background Information:
In order to provide the best possible service to the general public, companies, and agencies in the application
and issuance of construction and right-of-way use permits issued by the Public Works Department, the City is
developing and implementing a new land management and electronic permitting system. The new system will
enable information and permit applications to be directly obtained via the internet and accommodate electronic
permit processing for roadway construction and right-of-way use permits. The implementation and
administration of the new technology requires certain sections of the City Code to be amended to update and
identify requirements that will guide the general public through the electronic procedure, such as authority to
review applications, disclosures, surety requirements, insurance, fees, penalties, billing, inspections and permit
renewals. Implementation of these new procedures will reduce the amount of paper documents and expedite the
services provided by the Public Works Department.
Adjunct to the Public Works Department permitting procedures and in response to increasingly dense land
development, it is prudent to rationally correlate the services made necessary by the construction and/or
operation of private property upon the infrastructure and safety provided in the adjacent public right-of-way.
The recommended amendments to the City Code will define, clarify and update the minimum and maximum
limits of construction, maintenance and repair responsibility by property owners for roadway improvements
within the public right-of-way.
