HomeMy WebLinkAboutSubmittal-Commissioner Sarnoffi ..TITLE A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING, PURSUANT TO SECTION 54-341(E), THE RESTRICTIONS CONTAINED IN SECTION 54-341(C)(1),(2), AND (3) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY.CODE"), TO (1) WAIVE "rHE TWO EVENTS PER MONTH RESTRICTION, (2) WAIVE THE TWO EVENTS INVOLVING STREET CLOSURES, (3) WAIVE THE TWO EVENTS TAKING PLACE ON SUCCESSIVE WEEKENDS, AND (4) WAIVE THE APPLICATION AND REQUIRED APPROVALS IN SECTION 54-341(D) OF THE CITY CODE; AND WAIVING THE LIMITATIONS ON TEMPORARY SPECIAL EVENTS PURSUANT TO SECTION 906.9(C) OF ORDINANCE NO. 11000, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, FOR EVENTS OCCURRING IN THE COCONUT GROVE SPECIAL EVENTS DISTRICT DURING DESIGNATED SATURDAYS FROM SEPTEMBER 26, 2009 AND ENDING MARC 2A 2W; IN AND WAIVING THE SUPPLEMENTARY USER FEE, PURSUANT TO SECTIO 5_- 34X5) OF THE CITY CODE, FOR SAID EVENTS. �`'� m T� r co — r - Body WHEREAS, Commodore Plaza, located in the downtown Coconut Grove buiess s 6 district features some of the finest restaurants in Miami; and = N r co WHEREAS, pursuant to Resolution No. 09-0281, adopted June 11, 2009, theICity Commission approve the waiving of the SD. 2 special events restrictions for the pilot program, entitled "Summer Rendevous-Fall in Love with the Grove Again," for designated weekends in June, July and August, 2009; and WHEREAS, the program was a success without incident and helped revitalize the restaurants and shops along Commodore Plaza; and WHEREAS, the entire central business district benefitted from the increased foot traffic created by the lifted restrictions; and WHEREAS, the merchants of Coconut Grove have requested that the open weekend events be made permanent and have agreed to make a weekly financial contribution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 54-341(e), the restrictions contained in Section 54- 341(c)(1),(2), and (3) of the Code of the City of Miami, Florida, as amended ("City Code"), to (1) waive the two events per month restriction, (2) waive the two events involving street closures, (3) waive the two events taking place on successive weekends, and (4) waive the application and required approvals in Section 54-341(d) of the City Code, for events occurring in the Coconut Grove Special Events District on Saturdays from September 26, 2009 and ending March 20, 2010. Section 3. Pursuant to Section 906.9(c) of Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, the limitations on temporary special events, is waived. oq- o/oaz--%6mitfa1- Comm 1 ss loner Sarnoff Section 4. Pursuant to Section 54-343(5), all of the supplementary user fees, are hereby waived, for said events. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY .. Footnote {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
