HomeMy WebLinkAboutR-09-0418Vop City of Miami Legislation < U R �O Resolution: R-09-0418 File Number: 09-00926 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 9/10/2009 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), MAKING FINDINGS, AND DIRECTING THE PERMANENT PROHIBITION OF VEHICULAR ACCESS ALONG A PORTION OF SOUTHWEST 27 LANE, JUST EAST OF SOUTHWEST 26 AVENUE, MIAMI, FLORIDA, SUBJECT TO THE APPROVAL OF THE MIAMI-DADE COUNTY TRAFFIC DIRECTOR, IN THE NORTH COCONUT GROVE NEIGHBORHOOD OF THE CITY OF MIAMI, FLORIDA, IN ACCORDANCE WITH EXHIBIT "A", ATTACHED AND INCORPORATED, SUBJECT TO CONDITIONS AS SET FORTH HEREIN. WHEREAS, pursuant to Resolution No. 91-376, adopted on May 9, 1991, the Miami City Commission approved restricting a portion of Southwest 27 Lane, just east of Southwest 26 Avenue, Miami, Florida, to allow only one way west bound traffic; and WHEREAS, a group of property owners requested that the City of Miami ("City") prohibit vehicular access to said portion of Southwest 27 Lane, Miami, Florida ("SW 27 Lane"), due to numerous violations of the one-way street designation; and WHEREAS, the Capital Improvements Program conducted a Street Closure Study to evaluate the traffic conditions along SW 27 Lane, east of Southwest 26 Avenue, Miami, Florida; and WHEREAS, the results of the study concluded that the portion of SW 27 Lane should be closed because of cut -through traffic and violations of the one-way street designations, that are considered hazardous; and WHEREAS, the City constructed a half street closure to enforce its one-way traffic, west bound regulation on SW 27 Lane, pursuant to Resolution No. 91-376; and WHEREAS, the half street closure did not effectively deter violations of the one-way street designation; and WHEREAS, the Department of Police, Department of Fire Rescue, General Services Administration, Solid Waste Department, and Miami -Dade County Public Schools have evaluated the effects of the vehicular access restrictions upon their respective operations and have not expressed any objections; and WHEREAS, a complete street closure barricade design was created, including the recommendations of the various City Departments, to ensure that emergency vehicles could access the area at all times; and WHEREAS, property owners in the affected area voted, by more than a two-thirds (2/3) majority, in favor of installing permanent barricades during a special neighborhood election on August 8, 2008; and City of Miand Page 1 of 2 File Id. 09-00926 (Version: 1) Printed On: 6/28/2017 File Number: 09-00926 Enactment Number: R-09-0418 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Subject to the approval of the Miami -Dade County Traffic Director, it is hereby directed that vehicular access to a portion of SW 27 Lane, just east of Southwest 26 Avenue, Miami, Florida, in the north Coconut Grove neighborhood of the City of Miami, Florida, and in accordance with Exhibit "A", attached and incorporated, be permanently prohibited in accordance with the findings as set forth hereinabove, provided that the type of barricades shall be approved by the Department of Public Works. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1 } Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
