MELREESE CLUBHOUSE AND RESTAURANT FACILITY B-30566
This Amendment No. 1 to the Contract dated September 17, 2008, (the
"Contract") between the City of Miami, a municipal corporation of the State of Florida
("CITY"), and Tran Construction, Inc., ("CONTRACTOR") for the project entitled
"Melresse Clubhouse and Restaurant Facility, B-30566", ("PROJECT") is entered into
this day of 2009.
RECITALS
WHEREAS, the Contract was entered into pursuant to the approval of the City
Commission by Resolution No. 08-0463 in the total amount of $3,662,148, for the Scope
of Work as stated in the original Contract Documents for the PROJECT; and
WHEREAS, though the project was not originally contemplated to be Leadership in
Energy and Environmental Design ("LEED") certified, it was determined to be in the City's
best interest, as part of the Mayor's initiative to promote Green Building practices, to
pursue Leadership in Energy and Environmental Design ("LEED") Certification; and,
WHEREAS, thus, LEED-related revisions to the plans and subsequent change -
order items are now necessary; and,
WHEREAS, the LEED change order items, totaling $233,191.58, include:
dimming controls, HVAC equipment, storefront changes, additional landscaping, electrical
revisions, ductwork changes, etc.
WHEREAS, an additional $386,011 for equipment build -out is also required, which
will be primarily funded by the $350,000 contribution from the Miami Sports and Exhibition
Authority ("MSEA"), accepted July 23, 2009, pursuant to R-09-0386, for this purpose; and,
WHEREAS, it is now necessary to amend the Scope of Work to include the
additional work; and
WHEREAS, funds for the stated purpose are currently available from Project No.
B-30566, consisting of funds assembled from various sources and other funds as they
may become available; and
NOW THEREFORE, for the considerations hereinafter set forth:
The Agreement dated September 17, 2008, is hereby amended as follows:
1. ADDITIONAL WORK is hereby revised to include all labor, materials and
equipment required to perform the additional work, consisting of LEED
change order items, including: dimming controls, HVAC equipment,
storefront changes, additional landscaping, electrical revisions, ductwork
changes, etc; and consisting of equipment build -out pursuant to R-09-0386.
2. CONTRACT SUM is hereby increased by an amount not to exceed
$619,202.58, thereby increasing the total Contract Sum to Four Million Two

Hundred Eighty One Thousand Three Hundred Fifty Dollars and Fifty Eight
Cents ($4,281,350.58).
All other terms and conditions of the Contract are in effect and remain unchanged.
