HomeMy WebLinkAboutLegislationFile Number: 09-00893 City Half 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING AN INCREASE IN THE CONTRACT AWARDED TO AMERICAN EARTH MOVERS INC., FOR THE PROJECT ENTITLED, "ADEMAR AND DAVIS CANALS MAINTENANCE DREDGING, B-50680," FOR ADDITIONAL WORK, IN AN AMOUNT NOT TO EXCEED $159,560, INCREASING THE CONTRACT FROM $948,444, TO $1,108,044; ALLOCATING FUNDS, FOR SAID INCREASE, FROM CAPITAL IMPROVEMENT PROJECT NO. B-50680; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO, 1., IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. WHEREAS, five (5) bids were received by the Office of the City Clerk on January 16, 2009, for construction services for the project entitled "Ademar and Davis Canals Maintenance Dredging, B- 50806 ("Project"), pursuant to formal Invitation for Bids No. 08-09-019, issued December 12, 2008; and WHEREAS, American Earth Movers Inc., the lowest responsive and responsible bidder pursuant to said bids, submitted a bid in the amount of $948,444 for the Project; and WHEREAS, the contract was awarded on March 18, 2009, pursuant to the City's Expedite Ordinance No. 13045, adopted December 11, 2008; and WHEREAS, it has been determined that an additional fifteen hundred (1,500) cubic yards of sediment is required to be dredged in order to fulfill Department of Environmental Resources Management's ("DERM's") permit requirement to remove sediment down to seven (7) feet below water level, at a cost of $120,000; and WHEREAS, DERM requires that a wheel wash facility is necessary at the premises in order to maintain the cleanliness of vehicles used in the hauling of debris for the Project, at a cost of $39,560, for a total required increase of $159,560; and WHEREAS, Amendment No. 1, in substantially the attached form, addresses these change order items, thereby increasing the contract value by a not to exceed amount of $159,560, with funds currently available in Capital Improvement Project B-50680; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Section 3. Funds, in an amount not to exceed $159,560, for said increase, are allocated from Capital Improvement Project No. B-50680. Section 4. The City Manager is authorized{1 } to execute Amendment No. 1, in substantially the attached form, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BKO CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with ail requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
