ADEMAR AND DAVIS CANALS MAINTENANCE DREDGING, B-50680
This Amendment No. 1 to the Contract dated April 14, 2009, (the "Contract")
between the City of Miami, a municipal corporation of the State of Florida ("CITY"), and
American Earth Movers, Inc. ("CONTRACTOR") for the project entitled "Ademar and
Davis Canals Maintenance Dredging, B-50680", ("PROJECT") is entered into this
day of , 2009.
RECITALS
WHEREAS, the Contract was entered into pursuant to the approval of the City
Manager as part of the City's Expedite List pursuant to Ordinance 13045, in the total
amount of $948,444, for the Scope of Work as stated in the original Contract Documents
for the PROJECT; and
WHEREAS, initially observed dredging depths are no longer accurate as additional
sediments have been deposited in the canal and an additional fifteen hundred (1,500)
cubic yards of sediment is required to be dredged in order to fulfill DERM's permit
requirement to remove sediment down to seven (7) feet below water level; and
WHEREAS, DERM is requiring that a wheel wash facility is necessary at the
premises in order to maintain the cleanliness of vehicles used in the hauling of debris for
this project; and
WHEREAS, it is now necessary to amend the Scope of Work to include the
additional work; and
WHEREAS, funds for the stated purpose are currently available from Project No.
B-50680, consisting of funds assembled from various sources and other funds as they
may become available; and
NOW THEREFORE, for the considerations hereinafter set forth:
The Agreement dated April 14, 2009, is hereby amended as follows:
1. ADDITIONAL WORK is hereby revised to include all labor, materials and
- equipment required to perform the additional work, consisting of installation of
a wheel wash facility, and an additional fifteen hundred (1500) cubic yards of
dredging. The Additional Work shall be performed in a manner consistent will
all applicable terms and conditions of the Contract Documents.
2. CONTRACT SUM is hereby increased by an amount not to exceed $159,560,
thereby increasing the total Contract Sum to One Million One Hundred and
Eight Thousand and Four Dollars ($1,108,004).
