Final Action Date:
A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING, AND AUTHORIZING THE CITY MANAGER TO IMPLEMENT, THE
SECTION 3 ACTION PLAN, IN SUBSTANTIALLY THE ATTACHED FORM, TO
COMPLY WITH SECTION 3 OF THE HOUSING AND URBAN DEVELOPMENT
ACT OF 1968, AS AMENDED (12 U.S.C. 1701U), AND THE REGULATIONS OF
THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT, 24 CFR PART 135, IMPLEMENTING SECTION 3.
WHEREAS, the United States Congress passed Section 3 of the Housing and Urban Development
Act of 1968, as amended (12 U.S.C. 1701 u) ("Section 3"), to further the goal of ensuring that federal
funds benefit the residents of projects funded wholly or in part by those funds; and
WHEREAS, Section 3 ensures that employment and other economic opportunities generated by
certain financial assistance from the United States Department of Housing and Urban Development
shall, to the greatest extent feasible, and consistent with existing Federal, State and local laws and
regulations, be directed to low and very low-income persons, particularly those who are recipients of
government assistance for housing, and to business concerns that provide economic opportunities to
low and very low-income persons; and
WHEREAS, Section 3 is implemented by regulations of the United States Department of Housing
and Urban Development (24 CFR Part 135; the "Regulation") that establish the standards and
procedures to be followed to ensure that the objectives of Section 3 are met; and
WHEREAS, the City of Miami has developed the attached Section 3 Action Plan ("Plan") which
provides strategies to ensure compliance with the requirements of Section 3 and to achieve the
objectives of the Regulation; and
WHEREAS, the Plan covers the City of Miami Community Development Department's programs,
and is limited to Community Development Block Grant, HOME Investment Partnerships Program,
Housing Opportunities for Persons With AIDS and Emergency Shelter Grant housing construction,
housing rehabilitation and public improvement construction projects; and
WHEREAS, the Plan ensures the incorporation of Section 3 requirements in all procurements of
covered contracts and follows goal requirements set forth in the Regulation for awarding contracts;
and
WHEREAS, the Plan increases the likelihood of success in the recruitment, employment, and
utilization of low and moderate income residents and other eligible persons and businesses by
contractors working on Section 3 covered contracts;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Section 3 Action Plan, in substantially the attached form, is approved, and its
implementation by the City Manager is authorized. {1}
Section 3. This Resolution shall become effective immediately upon its adoption and signature
by the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
