Purpose of Item: Authorize the City Manager to execute a First Amendment to Revocable License Agreement ("Amendment"), in substantially the attached form, between the City of Miami ("City") and Allapattah-Wynwood Community and Development Center, Inc. ("Licensee"), approving the City's $26,355 in costs and expenses related to the roof repair of the 14,580 square foot City -owned property (the "Property"), located at 1500 NW 16`h Avenue, Florida, with the Licensee to reimburse $14,355 to the City ("Portion of the Costs and Expenses") on a monthly basis, with additional terms and conditions as more particularly set forth in said First Amendment. Director Chief City Manager_ V -0 7h Z Page I of 2 811,11a1 0 Subject: First Amendment to Revocable License Agreement with Allapattah-Wynwood Community and Development Center, Inc., a corporation organized under the laws of the State of Florida. Background Information: On April 17, 1991, the City issued a Revocable Permit to Allapattah-Wynwood Community and Development Center, Inc., a corporation organized under the laws of the State of Florida ("Licensee"), for use of the 14,580 square feet of city -owned property located at 1500 Northwest 16 Avenue ("Property"), to operate a day care facility serving city residents in the Allapattah neighborhood. On April 12, 2007, the City of Miami Commission adopted Resolution 07-0185 authorizing the City Manager to execute a Revocable License Agreement ("Agreement"), with the Licensee for the use of the Property to continue to operate a child day care facility, providing for a ten-year use period, an annual use fee of $1.00, and the Licensee to pay for all costs and expenses associated with changes to the Property. The proposed First Amendment will commence upon execution and authorizes the City to replace the Property's dilapidated roof in order to comply with all City, County and State building code requirements. The Licensee has agreed to reimburse the City $14,355 of the $26,255 of the costs and expenses associated with this one-time expenditure of replacing the roof; therefore, the Licensee will reimburse the City by remitting 28 monthly payments of $500 and one monthly payment of $355.
