HomeMy WebLinkAboutPre-Legislation 1�00City ���`� ` •=�� ' City of Miami Hall 3500 Pan American Drive �. �. ;'.,.... ��" 3' ' Legislation Miami, FL 33133 o+ cu F wwwr.miamigov.com Resolution File Number: 07-00253 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT ("LEASE"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND SCOTT ROBERTS MCNARY AND BETTY MARIE MCNARY, FOR THE USE OF 3,900 SQUARE FEET OF OFFICE SPACE AND RELATED PARKING AREAS LOCATED AT 1150 SOUTHWEST 22 STREET, MIAMI-DADE COUNTY, FLORIDA; SAID LEASE TO BE FOR AN INITIAL TERM OF TWO (2) YEARS, WITH A MONTHLY RENT OF $7,800 ($93,600 ANNUALLY), FOR THE FIRST YEAR, WITH FIVE (5) ADDITIONAL ONE-YEAR OPTIONS TO RENEW, SUBJECT TO BUDGETARY FEASIBILITY, WITH RENT INCREASES OCCURRING ANNUALLY BEGINNING IN THE SECOND YEAR TO BE INCREASED AT THE LOWER OF THE CONSUMER PRICE INDEX INCREASE OR THREE PERCENT (3%); ALLOCATING FUNDS FROM FEMA/USAR 2006 ACCOUNT NO. 18-180003.1292; WITH OTHER TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN THE LEASE; FURTHER AUTHORIZING THE CITY MANAGER TO APPROVE AND EXECUTE NON -SUBSTANTIVE AMENDMENTS TO SUCH LEASE AS NEEDED. WHEREAS, Urban Search and Rescue ("USAR") is a Federal task force.comprised of firefighters from across the South Florida region and provides search and rescue to some of the worst disasters in the United States; and WHEREAS, the City of Miami ("City"), through its Fire -Rescue Department, is the Sponsoring Agency for the Florida Task Force of USAR; and WHEREAS, the Sponsoring Agency is responsible for, among other things, .finding office space and being lead recipient of federal grants for task force purposes; and WHEREAS, the lease cost of $24.00 per square foot for the office selected by the Florida Task Force was found to be reasonable in comparison to other similar properties, and the City, on behalf of it's Department of Fire -Rescue as the lead USAR Sponsoring Agency, desires to enter into a lease agreement ("Lease"), in substantially the attached form, with Scott Roberts McNary and Betty Marie McNary (collectively, "Lessor") upon the terms and conditions set forth therein; and WHEREAS, the lease will be paid out of USAR Federal Grant funds; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is authorized{1) to execute a Lease, in substantially the attached form, between the City and the Lessor, for the use of 3,900 square feet of office space and related parking areas located at 1150 Southwest 22 Street, Miami -Dade County, Florida, with said Lease to be for an initial term of two (2) years, with a monthly rent of $7,800 ($93,600 annually), for the first year, with five (5) additional one (1) year options to renew subject to budgetary feasibility, with rent increases occurring annually beginning in the second year to be increased at the lower of the Consumer Price Index increase of three percent (3%), with funds allocated from FEMA/USAR 2006 Account, No. 18-180003.1292, with other terms and conditions as more particularly set forth in the Lease. Section 3, The City Manager is further authorized(l) to approve and execute non -substantive amendments to such Lease as needed. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS; JORG L, qERNANDEZ CITY AtTOIRNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from.the date it was passed and adopted.
