Those properties more specifically described in Exhibit "A" (the
"Properties")
Dear Ms. Fernandez:
Our Client is the owner of approximately 1.524 gross acres of land, consisting of five
pieces of property located along SW 37th Avenue (Douglas Road) and SW 361h Court, between
SW 9th Terrace and SW 12th Street, being more particularly described in the property legal
description attached hereto (Exhibit A).
The Properties are currently zoned R-3, with an underlying land use designation of
Office. Thus, the current land use and zoning are inconsistent. The Miami Comprehensive
Neighborhood Plan states that "areas designated as 'Office' allow residential uses to a
maximum density equivalent to'High Density Multifamily Residential.'
Consequently, we are seeking a rezoning to O so that the zoning will be consistent with
the land use. Our Client wishes to utilize the properties for higher residential density
apartments, as depicted in the attached plans. However, rather than seek a rezoning to R-4, we
are seeking to rezone to O so that the land use and zoning are consistent.
There is currently a trend of commercial and high rise use of the property along the
Douglas Road corridor. The current zoning designation does not utilize the urban setting along
Douglas Road. By rezoning the property to O, more housing can be provided within the urban
setting.
Our Client realizes that the rezoning of the Properties to O grants the owner certain
thresholds up to a certain density and intensity. Therefore, our Client is offering to covenant
that the development be in accordance with the attached plans, thereby ensuring that the
property is redeveloped at a density and intensity lower than the O zoning allows, but higher
than the current R-3.

We submit that the rezoning of the Properties to O for the proposed multifamily
apartment building is consistent with the City of Miami Comprehensive Neighborhood Plan and
compatible to the surrounding area. We thank you for your consideration and respectfully
