Dear Ms. Uguccioni, As you are aware, this firm represents the owner of the above referenced property (the "Property"). Pursuant to Section 8.1.8 of the Zoning ordinance of the City of Miami, this letter serves as the appeal of the Code Enforcement Department's denial of a tree removal permit. An application was filed for a permit to remove a 36" Mahogany tree (Tree #1) from the Property. The permit application is a consequence of the Tree #1's location on the Property as it relates to the proposed structure. It is impossible to complete the approved site plan without damaging Tree #1 or the structure. Specifically, Tree #1, as shown on the site plan, is within the proposed electrical room for Property's approved townhouse development. With respect to mitigating the removal of Tree #1, the owner of the Property is prepared to donate the required mitigation amount into the City's tree trust fund pursuant to Section 8.1.6.6 of the Zoning Ordinance of the City of Miami. Based on that section, and the 36" of total diameter of the tree to be removed, the mitigation amounts to twelve thousand dollars ($12,000.00). I appreciate your attention to this matter.
