Sent: Wednesday, July 22, 2009 2:35 PM To: Nelson, Ron; Thompson, Priscilla; Danie, Dwight Cc: Gomez, Marta; Rawlins, Tracy; Smith, Shirley Subject: Another revision re Coconut Grove Village Council resolution Importance: High Please review and let me know. - "lie follow4ig language (highlighted and ald caps) was added at the end of the title and at the end of SectJoin Z The cost will be paid by the Coconut Grove Village Cmincil PRIORTO SLATE OF CANDIDATES APPEARING"ON THE CITY BALLOT Thanks, (13 )aH -Title A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, AUTHORIZING THE REQUEST BY THE COCONUT GROVE VILLAGE COUNCIL TO THE MIAMI-DADE COUNTY SUPERVISOR OF ELECTIONS TO PLACE THE SLATE OF CANDIDATES FOR ELECTION TO THE COCONUT GROVE VILLAGE COUNCIL ON THE NOVEMBER 3, 2009, CITY OF MIAMI ("CITY") ELECTION BALLOT AS AN OFFICIAL CITY BALLOT QUESTION, AT THE APPROPRIATE PRECINCT(S), CONTINGENT UPON: 1) THE COCONUT GROVE VILLAGE COUNCIL MEETING ALL CRITERIA SET FORTH BY THE MIAMI-DADE COUNTY SUPERVISOR OF ELECTIONS AND 2) THAT THERE WILL BE NO ADDITIONAL COST TO THE CITY AND IF A COST IS IMPOSED, THE COST WILL BE PAID BY THE COCONUT GROVE VILLAGE COUNCIL PRIOR TO THE SLATE OF CANDIDATES APPEARING ON THE CITY BALLOT. ..Body WHEREAS, the Coconut Grove Village Council ("Council") was privately founded in the 1990s by residents of the City of Miami ("City") and serves as a forum for the residents and businesses of Coconut Grove to address issues of concern in the Coconut Grove community, to discuss proposed projects and events and to bring these issues to the attention of the City and Miami -Dade County officials; and WHEREAS, the area represented by the Council falls within the boundaries of the City's District 2 Commissioner, including the following voting precincts, 532, 540, 546, 581, 582, 583, 584, 585, 586, 587, and 998, which are attached hereto as Exhibit A; and WHEREAS, pursuant to Resolution No. 05-0488, adopted July 28, 2005, 4pe City granted the Council's request to "piggy -back" on the City's elections at no copt t�th �..e Council; and ` ` WHEREAS, the Council desires to again "piggy -back" on the City's el s � ns i; w be held on November 3, 2009 at no cost to the City and if a cost is assess, itffbe id by the Council; r a wig NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF fHI OF MIAMI, FLORIDA: Z; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Council is authorized to request the Miami -Dade County Supervisor of Elections to place the slate of candidates for election to the Council on the November 3, 2009 City election ballot as an official City ballot question, at the appropriate precinct(s), contingent upon: 1) the Council meeting all criteria set forth by the Miami -Dade County Supervisor of Elections and 2) that there will be no additional cost to the City and if a cost is imposed, the cost will be paid by the Council prior to the slate of candidates appearing on the City ballot. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1 } APPROVED AS TO FORM AND CORRECTNESS: JULIE 0. BRU CITY ATTORNEY {1 } If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City.
