This Amendment No. 1 to the Contract dated February 25, 2009, (the "Contract")
between the City of Miami, a municipal corporation of the State of Florida ("CITY"), and
Shoreline Foundation, Inc. ("CONTRACTOR") for the project entitled "Miamarina Pier
No. 5 Repairs/Dinner Key Marina Pier No. 3 Repairs, B -30325/60474A", ("PROJECT") is
entered into this day of 2009.
RECITALS
WHEREAS, the Contract was entered into pursuant to the approval of the City
Manager as part of the City's Expedite List pursuant to Ordinance 13045, total award
amount of $1,085,500, as stated in the original Contract Documents for the PROJECTS;
and
WHEREAS, there is an additional owner contingency of $108,550 for a total
contract amount of $1,194,050; and
WHEREAS, it is now necessary to amend the Scope of Work for the
Miamimarina Pier No. 5 Repair Project, B-30325, to include additional work due to
unforeseen conditions such as; revisions to the plans requested by FEMA due to flood
elevation changes and owner requested construction services that were not included in
the original scope of work; and
WHEREAS, funds for the stated purpose are currently available from Project No.
B-30325, consisting of funds assembled from various sources and other funds as
they may become available; and
NOW THEREFORE, for the considerations hereinafter set forth:
The Agreement dated February 25, 2009, is hereby amended as follows:
ADDITIONAL WORK is hereby revised to include all labor, materials and
equipment required to perform the additional work due to unforeseen
conditions such as revisions to the plans requested by FEMA due to flood
elevation changes and owner requested construction services that were not
included in the original scope of work The Additional Work shall be performed
in a manner consistent will all applicable terms and conditions of the Contract
Documents.
2. CONTRACT SUM is hereby increased by an amount not to exceed
$41,449.82, thereby increasing the total Contract Sum to One Million Two
Hundred Thirty Five Thousand Four Hundred Ninety Nine Dollars and Eighty
Two Cents ($1,235,499.82).
