HomeMy WebLinkAboutLegislation-SUB FRWHEREAS, the City Commission has adopted the recommendations of MiPlan, the City of Miami Climate Action Plan, which calls for the promotion of green building programs such as the United States Green Building Council ("USGBC") Leadership in Energy and Environmental Design ("LEED") rating system; and WHEREAS, the USGBC LEED rating system promotes sustainable sites, water conservation, energy efficiency, conservation of materials and resources, and indoor air quality; and WHEREAS, construction activities can have impacts on the indoor air quality of buildings for future occupants; and WHEREAS, in buildings with better indoor air quality, occupants tend to be more productive, efficient and more comfortable; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI: Section 1. The recitals and findings in the Preamble to this ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 22.5, of the Code of the City of Miami, Florida, as amended, entitled "Green Initiatives," is amended in the following particulars: {1} THIS DOCUMENT IS A "CHAPTER 22.5 SUBSTITUTION TO ORIGINAL GREEN INITIATIVES BACKUP. Intent. The City of Miami is committed to minimizing short and long term negative impacts that construction may have on the environment. The intent of this article is to increase indoor air quality in buildings for the benefit of its occupants. 22.5.3. Applicability. This ordinance shall apply to all construction sites under the authority and within the limits of the Citv of Miami which meet the criteria below. 1. Construction of a new residential building with three (3) or more units. 2. Construction of a new non-residential building, for projects of more than 4.000 total square feet. 3. Any substantial rehabilitation of a structure where the estimated construction cost exceeds fifty percent (50%) of the value of said structure. 22.5.4. Standards And Requirements: Construction. Construction IAQ Management Plan 1. Prior to the issuance of a Building permit, a statement of the plans detailing the Construction IAQ Management actions to be implemented during the construction and pre -occupancy phases of the building shall be submitted to the City and shall include: a. Construction IAQ Management plan that shall be based upon the recommended Control Measures of the Sheet Metal and Air Conditioning National Contractors Association (SMACNA) IAQ guidelines for Occupied Buildings under Construction, 1995, Chapter 3; and b. Proof that on-site or installed absorptive materials will be protected from moisture damage; and c. If permanently installed air handlers are used during construction, proof that filtration media with a Minimum Efficiency Reporting Value (MERV) of 8 will be used at each return air grille. In addition, all filtration media shall be replaced immediately prior to occupancy. 22.5.5. Compliance. Prior to the issuing of a Final Zoning inspection, a statement of substantial compliance will be submitted by the contractor. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately after final reading and adoption thereof. {2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O.
