Chief wL City Manager_ Pagel of 2 Subject: Acceptance of conveyance of FDOT Parcel located at the northeast corner of Bicentennial Park a/k/a Museum Park and I-395 to the City of Miami for use in the Museum Park Master Plan Background Information: On May 28, 2009, the City Commission adopted Resolution No. 09-0259, approving the terms of, and authorizing the City Manager to execute a tri -partite Development Agreement between the City, the Miami Art Museum of Dade County Association, Inc. (MAM) and the Museum of Science, Inc. (MSM) for the development of the Museum Park Component within Bicentennial Park a/k/a Museum Park which is an integral part of the Museum Park Master Plan. This Agreement was a natural progression for this overall project, which was preceded in December 11, 2008 by the passage of respective Leases between the City and the above-mentioned museums by Resolution 08-0707 in contemplation of the Development Agreement. The City needed the conveyance of a small parcel of land containing approximately +/- 1,543 square feet from FDOT in order to facilitate the construction of improvements for the Museum Park Master Plan. (This is the small area under the MAM parking garage and not the larger +/- 10,000 square foot turnaround area). The City therefore requested that State of Florida Department of Transportation ("FDOT") convey a small triangular FDOT parcel that is located in the northeast comer of Bicentennial Park a/k/a Museum Park. The Property is not currently in use by FDOT for state highway purposes. FDOT is willing to convey the Property to the City at no charge for use in connection with the Museum Park Master Plan but such use must serve a public purpose. In the event that the Property is not used in conformity with the Museum Park Master Plan, the Property shall revert to FDOT. Page 2 of 2
