HomeMy WebLinkAboutLegislationCity of Miami City Hall �. c '�, 3500 Pan American Drive G,.c'aue Legislation I:%- Miami, FL 33133 '°. qw ac,:' ww.miamigov.com ' Resolution File Number: 09-00689 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT FROM THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), A PARCEL OF LAND CONTAINING APPROXIMATELY +/- 1,543 SQUARE FEET, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, OF FDOT PROPERTY LOCATED AT THE NORTHEAST CORNER OF BICENNTENNIAL PARK A/K/A MUSEUM PARK, MIAMI, FLORIDA, ADJACENT TO 1-395, BY QUITCLAIM DEED, WITH A PUBLIC PURPOSE REVERTER PROVISION, IN SUBSTANTIALLY THE ATTACHED FORM, TO BE USED IN CONNECTION WITH THE DEVELOPMENT OF THE MUSEUM PARK MASTER PLAN; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS WHICH ARE NECESSARY TO EFFECTUATE SAID ACQUISITION. WHEREAS, the State of Florida Department of Transportation ("FDOT") is the owner of a certain parcel in the vicinity of the northeastern corner of Bicentennial Park a/k/a Museum Park adjacent to 1-395 ("Property"); and WHEREAS, the Property is no longer required for state highway purposes by FDOT; and WHEREAS, FDOT is willing to convey the Property to the City of Miami ("City") at no charge but FDOT has required a public purpose reverter provision; and WHEREAS, it is necessary that said Property be accepted by the City in order to facilitate the construction of improvements for the Museum Park Master Plan, more specifically to facilitate construction of a new art museum by Miami Museum of Art of Dade County Association, Inc.; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to accept from FDOT, a parcel of land containing approximately +/- 1,543 square feet, as more particularly described in Exhibit "A", attached and incorporated, of FDOT Property, by a Quitclaim Deed, with a public purpose reverter provision, in substantially the attached form. Section 3. The City Manager is further authorized{1} to execute all documents which are necessary to effectuate said acquisition. Section 4. BRU 0n CITY ATTORNEY u'�" Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
