HomeMy WebLinkAboutR-09-0333Vop City of Miami Legislation < U R �O Resolution: R-09-0333 File Number: 09-00681 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 7/9/2009 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE TRANSFER OF DEPARTMENT OF COMMUNITY DEVELOPMENT COMMUNITY DEVELOPMENT BLOCK GRANT HOUSING ACTIVITIES FUNDS, IN THE TOTAL AMOUNT OF $800,000, AS SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED TO THE CITY OF MIAMI DEPARTMENT OF COMMUNITY DEVELOPMENT FOR RELOCATION ASSISTANCE UNDER THE UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITIONS ACT AND FOR EMERGENCY ASSISTANCE UNDER THE OPTIONAL RELOCATION ASSISTANCE POLICY; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS FOR SAID PURPOSE(S). WHEREAS, federal regulations implementing the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 ("URLA") provide for relocation assistance to temporarily and permanently displaced persons, including, payments for moving expenses, replacement housing payments for the increased costs of renting or purchasing a comparable replacement dwelling, reimbursement for reasonable out-of-pocket expenses incurred in connection with a temporary relocation, and permanent relocation assistance; and WHEREAS, pursuant to Resolution No. 06-0647, adopted November 9, 2006, the Miami City Commission authorized the transfer of Home Investment Partnerships Program ("HOME") funds, in the total amount of $81,580.19, to the City of Miami Department of Community Development for relocation rental assistance for tenants displaced from properties acquired by the Model City Trust/City of Miami since November 2, 2004; and WHEREAS, pursuant to Resolution No. 08-0335, adopted June 12, 2008, the Miami City Commission authorized the transfer of City of Miami Department of Community Development Housing Activities funds in the amount of $500,000 to the Department of Community Development Relocation Assistance account for the tenants displaced from the property located at 1240 Northwest 61 st Street; and WHEREAS, the City is ready to implement its activities under the Neighborhood Stabilization Program, which may result in the displacement of persons covered by the URLA; and WHEREAS, it is also important for the City to have funds available for emergency relocation assistance in case of natural or man-made disaster; and WHEREAS, the Administration is requesting the transfer of Community Development Block Grant ("CDBG") funds in the total amount of $800,000, as specified in Exhibit "A", attached and incorporated, to the City of Miami Department of Community Development for relocation assistance as required under the URLA and for emergency relocation assistance under the Optional Relocation City of Miand Page 1 of 2 File Id. 09-00681 (Version: 1) Printed On: 6/26/2017 File Number: 09-00681 Assistance Policy ("ORAP") for displaced tenants; Enactment Number: R-09-0333 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The transfer of Department of Community Development CDBG Housing Activities funds in the total amount of $800,000, as specified in Exhibit "A", attached and incorporated, to the City of Miami Department of Community Development for relocation assistance required under the URLA and for emergency assistance under the ORAP for displaced tenants, is authorized. Section 3. The City Manager is authorized {1} to execute all necessary documents for said purpose(s). Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
