A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING, AND AUTHORIZING THE CITY MANAGER TO IMPLEMENT: (1)
THE RESIDENTIAL ANTI -DISPLACEMENT AND RELOCATION ASSISTANCE
PLAN, REGARDING COMPLIANCE WITH THE UNIFORM RELOCATION
ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES ACT OF 1970
AND SECTION 104(D) OF THE HOUSING AND COMMUNITY DEVELOPMENT
ACT OF 1974, AND (2) THE OPTIONAL RELOCATION ASSISTANCE POLICY, IN
SUBSTANTIALLY THE ATTACHED FORM.
WHEREAS, the City of Miami Consolidated Plan process combines the planning and
application aspects of the Community Development Block Grant ("CDBG") and the Home Investment
Partnerships Program ("HOME") formulas, among others, into a single application for federal funding
from the U.S. Department of Housing and Urban Development ("HUD"); and
WHEREAS, the goal of the Five -Year Consolidated Plan is to provide decent, safe, and
sanitary housing, develop suitable living environments and to expand economic opportunities; and
WHEREAS, pursuant to federal statutes and regulations, including, but not limited to, the
Housing and Community Development Act of 1974, as amended, 24 CFR Part 570 and 24 CFR Part
92, as the recipient of HUD funding, the City of Miami must develop, make public, and certify that it is
following a Residential Anti -Displacement and Relocation Assistance Plan regarding compliance with
the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 and Section
104(d) of the Housing and Community Development Act of 1974; and
WHEREAS, having an Optional Relocation Assistance Policy in place will allow the City to
provide relocation assistance for residents displaced by natural or man-made disasters;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The Residential Anti -Displacement and Relocation Assistance Plan and the Optional
Relocation Assistance Policy, in substantially the attached form, are approved and their
implementation by the City Manager is authorized. {1)
Section 3. This Resolution shall become effective immediately upon its adoption and signature
by the Mayor. {2)

f 11 The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
