A RESOLUTION OF THE CITY OF MIAMI COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AIRSPACE AGREEMENT
("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE FLORIDA
DEPARTMENT OF TRANSPORTATION ("FDOT"), FOR THE DEPARTMENT OF PUBLIC
WORKS' USE AND OCCUPANCY OF THE PROPERTY LOCATED UNDER I-95 AT
NORTHWEST 72ND STREET MIAMI, FLORIDA, FOR A TERM OF THREE (3) YEARS, WITH AN
OPTION TO EXTEND FOR AN ADDITIONAL ONE (1) YEAR TERM, COMMENCING UPON
APPROVAL BY FDOT'S DISTRICT SECRETARY, WITH NO RENT BEING CHARGED TO THE
CITY OF MIAMI, WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN
THE AGREEMENT.
WHEREAS, the Florida Department of Transportation ("FDOT") owns certain property located under Interstate 95 at
Northwest 72nd Street, Miami, Florida ("Property"); and
WHEREAS, FDOT does not have a current need for the Property; and
WHEREAS, FDOT is desirous in allowing the City of Miami ("City") to use its Property and the City is in need of space
to use for its parking and equipment storage for the Department of Public Works; and
WHEREAS, FDOT and the City have negotiated an Airspace Agreement ("Agreement"); and
WHEREAS, the Agreement provides that there will be no charge to the City for its use of the Property; and
WHEREAS, the term of the Agreement is for three (3) years with the option to extend for an additional one (1) year term;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1) to execute an Agreement, in substantially the attached form, with FDOT
for the Department of Public Works' use and occupancy of the Property, for a term of three (3) years, with an option to
extend for an additional one (1) year term, commencing upon approval by FDOT's District Secretary, with no rent being
charged to the City, with terms and conditions as more particularly set forth in the Agreement.
