Subject: Second Addendum to the Airspace Agreement between the City of Miami ("City") and the Florida
Department of Transportation ("FDOT") for use of FDOT-owned space located at 1-95 at Northwest 72 Street,

Purpose of Item:
A Resolution of the City of Miami Commission, with attachments, authorizing the City Manager to execute the
Second Addendum, in substantially the attached form, to the Airspace Agreement ("second addendum"),
between the City of Miami ("City") and the Florida Department of Transportation ("FDOT"), to provide for the
inclusion of 0.7266 acres, or 31,652 square feet, to the leased property located under 1-95 at northwest 72nd
street, Miami, as more particularly described in Exhibit "A" attached hereto and made a part hereof, for the
Department of Public Works' use and occupancy, with no rent being charged to the City, with terms and
conditions as more specifically set forth in said Second Addendum.

Subject: Second Addendum to the Airspace Agreement between the City of Miami ("City") and the Florida
Department of Transportation ("FDOT") for use of FDOT-owned space located at 1-95 at Northwest 72 Street,
Miami, Florida
Background Information:
On December 13, 2007, the City Commission approved the Airspace Agreement ("Agreement") between the
City and FDOT providing the City with use of 1.477 acres of FDOT-owned property located under 1-95, near
NW 72 Street, Miami, Florida ("Property"). The Agreement authorized the City's Public Works department to
use the Property for parking and storage of its equipment and vehicles, for three (3) years with an option to
extend one additional year, with no rent charged to the City. The Second Addendum to the Airspace
Agreement ("Second Addendum") authorizes the City to include an additional 0.7266 acres to the Property.
The term of the Second Addendum ends May 19, 2011, with a single one-year renewal option provided.
There will be no rental fee charged by FDOT. The City will be responsible for maintenance. FDOT will retain
responsibility of any replacement needs of the highway not caused by the negligence of the City. FDOT
retains the right to access the Property for routine maintenance and repairs.
