HomeMy WebLinkAboutR-09-0324Vop City of Miami Legislation < U R �O Resolution: R-09-0324 File Number: 09-00669 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 7/9/2009 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO RETROACTIVELY EXERCISE THE OPTION TO RENEW FOR TWO (2) ADDITIONAL ONE-YEAR PERIODS CONTAINED IN THE AGREEMENT EXECUTED WITH ENVIROWASTE SERVICES GROUP, INC., FOR THE PROJECT ENTITLED "CITYWIDE OUTFALL CLEANING PROJECT, B-30256", PURSUANT TO RESOLUTION NO. 05-0446, ADOPTED JULY 28, 2005, AND TO ACCEPT THE EXECUTED ADDENDUM TO SAID AGREEMENT, IN THE ANNUAL AMOUNT NOT TO EXCEED $199,995, FOR A TOTAL CONTRACT AMOUNT DURING THE OPTIONAL YEARS OF $399,990, SUBJECT TO BUDGETARY APPROVAL AT THE TIME OF NEED. WHEREAS, pursuant to Resolution No. 05-0446, adopted June 28, 2005, the City Commission awarded a contract to Envirowaste Services Group, Inc. for the project entitled "Citywide Outfall Cleaning Project. B-30256" for a two-year period, in the annual amount not to exceed $199,995, for a total contract amount not to exceed $399,990; and WHEREAS, the contract provided an option to renew for two (2) additional one-year periods; and WHEREAS, Resolution No. 05-0446 did not properly allocate the funds for the available option years; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the City to authorize the City Manager to retroactively exercise the option to renew for two (2) additional one-year periods and to accept the executed addendum to said agreement, in the annual amount not to exceed $199,995, for a total contract amount during the optional years of $399,990, subject to budgetary approval at the time of need; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1 } to retroactively exercise the option to renew for two (2) additional one-year periods contained in the agreement executed with Envirowaste Services Group, Inc. for the project entitled "Citywide Outfall Cleaning Project. B-30256", pursuant to Resolution No. 05-0446, adopted July 28, 2005, and to accept the executed addendum to said Agreement, in the annual amount not to exceed $199,995, for a total contract amount during the optional years of $399,990, subject to budgetary approval at the time of need. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
