Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning Ordinance of
the City of Miami, Florida, the subject proposal has been reviewed for an amendment to the
Zoning Atlas as follows:
The subject property consists of four lots fronting North Miami Avenue and N.E. Miami
Court (a complete legal description on file at the Hearing Boards Office), requesting a
zoning change from O "Office" to C-1 "Restricted Commercial."
The following findings have been made:
It is found that the parcels are part of an office designated area and that the requested
zoning change will represent an intrusion of commercial uses into the office designated
area.
• It is found that the requested C-1 "Restricted Commercial' designation could be an isolated
designation surrounded by O "Office" designation at the north, east, and south of the
property and the City limits on the west.
• It is found that the proposed zoning change at this location may set a negative precedent
and create a "domino effect" in regards to zoning change applications.
• It is found that on February 18, 2009 the Planning Advisory Board recommended denial of
the land use request from "Office" to "Restricted Commercial'.
Based on these findings, the Planning Department is recommending denial of the
application as presented.
