Appeal of Decision of Zoning Board (Resolution No. ZB-R-09-0020)
Dear Ms. Fernandez;
Our firm represents Aquarela, LLC (the "Applicant") regarding the property located at the
above -referenced address in the City of Miami (the "Property"). The purpose of this letter is to
request that the City Commission review the Zoning Board's denial of a Special Exception and
Class II and Class I Special Permits for the Property, item Z.6 on the Meeting Agenda of April
13, 2009, as evidenced by Resolution No. ZB-R-09-6626, a copy of which is attached hereto.
Aquarela Condominiums (the "Project") is a proposed multi -family residential building
located in the SD -14 (Latin Quarter Cam mercial-Residential and Residential Districts), and
within a community revitalization district (CRD), as identified by the City of Miami. The Project
will be a 9 -story building with thirty-three one -bedroom and two-bedroom units intended to be
marketed to a workforce population.
On April 13, 2009, the Applicant appeared before the Zoning Board to request approval
of a Special Exception under Ordinance 11000, as amended, Article 9, Section 917.7.2 for a
reduction in parking requirements for multifamily residential development located in a CRD from
a total of 61 spaces to 36 spaces; for Class 11 Special Permits to allow for new development in
SD -14, to allow for a reduction in one (1 ) loading berth dimensions from 12x35x15 to 10x20x15,
to allow maneuvering of trucks on public rights-of-way, and to allow a waiver from the City of
Miami Parking Guides and Standards for reduction of required backup distance from 23 feet to
22 feet; and for various Class I Special Permits for the Property. In violation of the City of Miami
Zoning Cade, Ordinance 11000, as amended and the City's designated CRDs, and citing
disagreement with the concept of parking reductions warranted under Section 917.7.2, the
Zoning Board unanimously denied the application.

The Applicant files this timely appeal to challenge the decision of the Zoning Board,
pursuant to Section 2001, Article 20 of the Zoning Code, and to present the merits of this
special exception.
First, the Project is consistent with the character of the surrounding neighborhood. The
neighborhood includes a mix of residential and commercial uses and the neighborhood will
benefit from new multi -family housing along the 17" Avenue corridor to provide new housing
opportunities to residents.
Second, the application is consistent with the policy established by the City of Miami that
explicitly provides for reductions in parking spaces for multi -family residential development
located in CRDs. Section 917.7.21 a copy of which is attached hereto, was created as a
mechanism for reducing parking requirements for residential development in recognition of the
reduced vehicle ownership rates in these areas. Specifically, Section 917.7.2 provides for
"reductions by special exception" which shall comply with "the following minimum
requirements":
1. One (1) bedroom and studio units (with or without dens or other such similar
spaces). One (1) parking space per unit
2. Two (2) bedroom units: One (1) parking space per unit
3. Three (3) bedroom units: Two (2) parking spaces per unit
This Project will have thirty-three units (all one -bedroom and two-bedroom units).
Consistent with Section 917.7.2, the Project has thirty-three (33) parking spaces for residents
and three (3) visitor spaces for a total of thirty-six (36) spaces.
Third, statistical data evidences a low -rate of car ownership in the surrounding area.
The Property is located in Census Tract 53,01, Miami -Dade County, According to statistical
data from the Census 2000, the most recent available census data to date, in Census Tract
53.01, Miami -Dade County, the median vehicles per household for owner -occupied units is 0.8
and the median vehicles per household for renter -occupied units is 0.7. Furthermore, 48.8% of
households in Census Tract 53.01, Miami -Dade County reported not owning any vehicles. The
Zoning Board rejected this census data in denying the special exception.
Fourth, the Zoning Board previously approved the same application for a special
exception. On November 14, 2005, the Zoning Board reviewed and approved a Special
Exception to allow a reduction in parking requirements by 43% on this Property Linder
Resolution 05-0181, a copy of which is attached hereto. On October 16, 2006, the Zoning
Board approved an extension of time under Resolution 06-1239, a copy of which is attached
hereto. Unfortunately, the Applicant experienced unforeseen circumstances and could not
obtain a building permit prior to the expiration date. The application filed on March 4, 2009 and
before the Zoning Board on April 13, 2009 is an identical application to the application
previously -approved by the Zoning Board under Resolution 05-0181.

Lastly, the City of Miami Planning Department recommended approval of the application
with minor conditions, of which the Applicant concurs. The Applicant worked diligently with staff
to prepare the application. The I DRC reviewed the Project on March 31, 2009 and recommend
favorable treatment of the Project and its comments were incorporated into the Planning
Department's recommendation for approval. The Zoning Board ignored the recommendation of
the Planning Department in their discussion of the item, and denied the special exception solely
based on personal opinions of board members regarding car -ownership and other socio-
economic data concerning the population living in the area surrounding the Property.
For the aforementioned reasons, the Applicant respectfully requests review by the City
Commission of Resolution No. ZB-49-0020. Enclosed herein is a proof of lobbyist registration,
proof of paid receipt of original application, and pertinent supporting materials. Thank you for

Reductions in parking requirements for multifamily residential development may be
approved, pursuant to a Special Exception Permit, when such development is located
within a CR❑ as determined by the planning and zoning department.
Such reductions by Special Exception Permit shall not fall below the following minimum
requirements and such developments shall not be eligible for variances in conjunction
with this reduction:
