A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
RESCINDING RESOLUTION NO. 08-0012, ADOPTED JANUARY 10, 2008, TO THE
EXTENT THAT IT AUTHORIZED THE CONVEYANCE OF THE PROPERTY
LOCATED AT 1336 NORTHWEST 60TH STREET, MIAMI, FLORIDA, TO
EQUITABLE HOUSING CORP.; RESCINDING RESOLUTION NO. 08-0337,
ADOPTED JUNE 12, 2008, TO THE EXTENT THAT IT AUTHORIZED THE
CONVEYANCE OF THE PROPERTY LOCATED AT 1590 NORTHWEST 54TH
STREET, MIAMI, FLORIDA, TO MINIQUE PROPERTIES AND INVESTMENTS, INC.;
AUTHORIZING THE CONVEYANCE OF THE PROPERTY LOCATED AT 1336
NORTHWEST 60TH STREET, MIAMI, FLORIDA, AS LEGALLY DESCRIBED IN
EXHIBIT "A", ATTACHED AND INCORPORATED, TO MINIQUE PROPERTIES AND
INVESTMENTS, INC. FOR THE DEVELOPMENT OF AFFORDABLE HOUSING,
SUBJECT TO ALL RESTRICTIONS PROVIDED IN RESOLUTION NO. 08-0337;
AUTHORIZING THE CITY MANAGER TO EXECUTE A PURCHASE AND SALE
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, AND ALL OTHER
NECESSARY DOCUMENTS FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No. 08-0012, adopted January 10, 2008, the Miami City
Commission authorized the conveyance of the parcel of land located at 1336 Northwest 60th Street,
Miami, Florida, to Equitable Housing Corp; and
WHEREAS, pursuant to Resolution No. 08-0337, adopted June 12, 2008, the Miami City
Commission authorized the conveyance of the parcel of land located at 1590 Northwest 54th Street,
Miami, Florida, to Minique Properties and Investments, Inc. ("Minique"); and
WHEREAS, on July 14, 2008, Equitable Housing Corp. informed the City of Miami Department of
Community Development that it would no longer be able to proceed with the development of its
affordable housing project due to the current economic conditions; and
WHEREAS, after a detailed analysis of the parcel located at 1590 Northwest 54th Street, Miami,
Florida, it was determined that the property is zoned for restricted commercial purposes and Minique's
construction of a twin townhome project would not be the best use of the site; and
WHEREAS, the Administration recommends: (1) rescinding Resolution No. 08-0012 to the extent
that it authorized the conveyance of the property located at located at 1336 Northwest 60th Street,
Miami, Florida, to Equitable Housing Corp., (2) rescinding Resolution No. 08-0337, to the extent that it
authorized the conveyance of the property located at 1590 Northwest 54th Street, Miami, Florida, to
Minique, and (3) authorizing the conveyance of the property located at 1336 Northwest 60th Street,
Miami, Florida, as legally described in Exhibit "A" attached and incorporated, to Minique for the
development of an affordable single family home, subject to all restrictions provided in Resolution No.
08-0337;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The rescission of Resolution No. 08-0012 to the extent that it authorized the
conveyance of the property located at located at 1336 Northwest 60th Street, Miami, Florida, to
Equitable Housing Corp., and the rescission of Resolution No. 08-0337 to the extent that it authorized
the conveyance of the property located at 1590 Northwest 54th Street, Miami, Florida to Minique
Properties and Investments, Inc., are approved.
Section 3. The conveyance of the property located at 1336 Northwest 60th Street, Miami, Florida,
as legally described in Exhibit "A" attached and incorporated, to Minique Properties and Investments,
Inc. for the development of an affordable single family home, subject to all restrictions as stated in
Resolution No. 08-0337, is authorized.
Section 4. The City Manager is authorized {1} to execute a Purchase and Sale Agreement in
substantially the attached form and all other necessary documents for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
