WHEREAS, pursuant to Resolution No. 08-0641, adopted November 23, 2008, the Miami City Commission approved the acceptance of a grant from the United States Department of Housing and Urban Development ("HUD") under the Housing and Economic Recovery act of 2008 in the amount of $12,063,702 for the implementation of the Neighborhood Stabilization Program (NSP"); and WHEREAS, on March 13, 2009, the NSP grant agreement between the City of Miami ("City") and HUD was executed by the City Manager, as indicated in Exhibit "B", attached and incorporated; and WHEREAS, pursuant to Special Condition #1 of the NSP grant agreement, before the City can access the NSP funds, the City is required to submit a repayment plan for the outstanding obligations due to HUD because of certain compliance issues; and WHEREAS, the City has negotiated with HUD to repay the outstanding obligations, as set forth in Exhibit "A", attached and incorporated; and WHEREAS, the Department of Community Development has made changes to its policies and procedures which have been communicated to and accepted by HUD to ensure that these compliances issues are never repeated; and WHEREAS, the Administration recommends approval of the repayment plan between the City and HUD to allow the City to access the NSP funds; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF NIIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2.
